Selling a house without the Deeds.

    It's up to you. If MinLaw's name is off the title but the restriction (indicating that the proprietors are Tenants in Common) is still there it might just confuse matters. It can all be dealt with at the same time so I wouldn't worry unless you want to do it now.

    Quite right. The last thing he needs to bother about if he's not well. It sounds like this has all been thought of when they made their wills.

    Thanks everyone - FIL wants to have every "Tidied up" before his illness progresses and was very worried about the loss of his deeds.

    I can truthfully tell him that there's no need to worry on any front. It will be a weight off his mind.

    If you really want the deeds, the chances are that they are in the safekeeping of the solicitors who dealt with the house purchase.


    We bought our house 43 years ago and the solicitors offered to store them free of charge (obviously hoping for the custom, should we sell).

    MIL let her share of the estate to FIL.

    I'm happy that, after reading all of the above comments, things will be fine when the time comes to execute the will.

    As he inherited it, there shouldn't be any problems at all.

    Very odd to go to the bother of severing a joint tenancy and then to leave their share to each other.
