If everything you say is totally true then your partner has been hard done by.
But if you just sit down and have a think about it you should be able to understand why there was/is so much scepticism about the circumstances.
And he was asked to go to court, but when it was explained that he didn't absolutely have to, he chose to write - which does not carry the same effect as turning up in person to explain and say that you regret what happened etc.
I'm sorry that you think that some of has been rude - I think it was more bluntness than rudeness though..
We all have to set our own priorities in life and that's how it is.
For me work commitments would come second to me having a clean licence. The repercussions are far greater and potentially expensive than a days pay.
And the same goes for the court appearance.0 -
I apologise for being snippy. I really have nothing to gain by lying. Obviously if he were doing 45 then the circumstances would be entirely different and any advice would be useless to me! The road is in Chorley in nw England, I don't know which one.
It seems he probably didn't take it serious enough, he was told court was a formality due to him not doing the course and he honestly believed he would be offered another date. Naivety on his part. Either way, he'll pay the fine but I'm still trying to find out if he can appeal the 6 points.0 -
Has he actually been told he will receive six points and the fine stated or does the letter state it may be up to that amount and points?
I'm sorry but I don't go along with those who say that failure to attend court in best bib and tucker means a higher fine and more points. If an offence merits 3pts because of its nature (which 34 in a 30 does) then that is what they they should receive. Mitigation in person (or in writing) might bring a 6pt offence down to 3 or 4, but I can see no reason why he apparently got 6pts.0 -
The letter says he is getting 6 points. I will get him to screen shot and send to me so I can write the exact words. I thought the points had gone up due to him not completing the course but apparently that's wrong.0

115 - fine
20 - victim sur
85 - costs
Total 220. I understand the costs are due to it going to court but the points are what I'm querying.0 -

OK. The fine etc. are all consistent with the offence, the points aren't.
It may simply be a mistake in the letter. I'd phone the court and ask them.0 -

'Manned equipment' generally refers to a van, which means human discretion has been made whether to prosecute from the recorded footage; as opposed to automated equipment (fixed speed cameras) set to go off above a fixed threshold.0

What exactly did he state in his mitigating circumstances when pleading guilty? Can you copy and paste the wording?What about penalty points?
The normal punishment for a speeding offence is 3 to 6 penalty points, depending on the severity of the allegation, circumstances of the offence and mitigation, to include the driver's past record.

He said it was an officer stood at the side of the road with a speed gun thing, he wasn't followed at all.
Sorry, he's away working at the moment so I can't get any more info from him until tonight. The mitigating circumstances I believe refer to the non attendance of the course rather than the actual offence if you see what I mean. He was previously stopped for running a red (Amber actually) light. He attended a driver awareness course for that and didn't receive any points.
If this was a factor then I still don't understand why the original ticket was for 3 points?0
