help! caught with no mot, dealer at fault

    I'd expect the dealer to reimburse you the fine and arrange for a current MOT. Ring them and tell them whats happened and for them to arrange to collect the car for an MOT.

    I would ask the dealer to MOT the car at their expense. They will argue faults may have developed in the previous six months but they owe you an MOT and the car was not as described. You may be able to reclaim the fine and possibly further costs from them. Ask on the consumer rights board.

    Op bought a car on the basis the garage have a safety check done, so it's reasonable to assume when op collects the car the condition is just that. Not that it's on the road unlawfully and potentially unsafe.

    You were driving a car that doesn't have a valid MOT....a criminal offence but not a serious one.

    You're lucky you never had an accident because your insurance would most likely have been invalid.

    im not for a second making out im not at fault here but i wouldn't be able to set up my own business and basically rip people off and possibly put lives at rist and get away with it now would i, a side to this people are forgetting.

    I think you are getting a lot of stick on this thread because you aren't taking responsibility for this at all. I think if you approach this from:

    "Put my hands up, this was my mistake but the dealer also made a balls up" point of view

    then you would get more sympathy. You should have checked the MOT paperwork - nobody else should have done this for you.

    So - get an MOT.
    Then pay your fine
    Also complain in writing to the dealer, at the very least you should get a refund for any expenses relating to the MOT - the MOT itself and any reasonable repairs in my view.
    Then you can negotiate about any ex gratia payments due to their mistake.

    Always check the reputation of whatever company you use, for anything. The most reputable companies are often very good value too. It's such an easy thing to do, it takes a few minutes of research and saves you so much hassle.

    And yes, it is your fault. The dealer told you it had 12 months MOT; so what? It's a £100 fine; pay it, get an MOT and move on. What's the problem here?

    You've already been given perfectly sensible advice on here. . .

    Don't get mad just because we're not as outraged as you.

    What do you seriously expect? That people on a money saving forum can give you a sure fire way of convincing a judge to let you off with driving a car without an MOT!


    If you want to try your luck with a Judge then on you go....don't expect him to be as friendly as we are though...
