Phones 2U Direct defeated in court today

I have determined today that the case which phones2udirect lost in Tunbridge Wells County Court on 6th August 2007 was Graham v phones2udirect if anyone wants to try to cite it. I do not have the Claim/Case No., but no doubt if anyone wants this they can obtain it from the Tunbridge Wells County Court Office, Tel: 01892 515515.0

Our situation is that we have lost our original invoice (d'oh) and therefore our first cashback claim was refused.
We requested a replacement as soon as we realised and they even responded saying that they would, but as it wasn't the original would not be eligable for the cashback claim....!!! They never actually sent the copy invoice either.
The T&Cs state that you 'should' send in the invoice. Is it worth pursuing on the basis that:
1. The contract is a tad unfair and having noted our problem offered to send a replacement but this would not be acceptable, or...
2. The term 'should' doesn't to me sound very forceful, rather a 'ough to, but don't have to' kind of statement.
Anyone else tried any of these approaches or anyone with a legal brain, especially with the definition of 'should'? Any help would be appreciated - getting a tad fed up with comanies in the UK trying to fleece their customers..!!!

Hi, as this thread is about P2UD and the inevitable small claims court submission, I wonder if someone could share the text (personal info removed/obscured) for a court claim that worked well for you.
My situation is :
* Followed the T&C's
* Sent claims by special/recorded delivery
* Had the first claim paid, by issuing a letter before action, to which they tried to time it so that I made the small claims court claim and paid me at the same time
* Issued a letter before action for the second claim
* About to send off the third and final claim
* Reported each time to Trading Standards
* No communication from P2UD, apart from first claim letter and cheque
If you could share the text it would be useful to many people, as I'm sure there are other people in a similar situation.

speak to the Managing Director and the result was instant. His name is David Ellis and his personal line number is:01732 765401. His email address is believed to be [EMAIL="david.ellis@phones2udirect.co.uk"]david.ellis@phones2udirect.co.uk[/EMAIL] (he does not reply of course, but emails do not bounce back either). According to Company House records his registration number is :12512897 and his home address is listed as: Hartley, Longfield, Kent, DA3 8EX. Unfortunately, I was not able to establish his home telephone number.

He's certainly taking a good bit of the money the company screw from customers. He paid 825k for his house in July 2002. At elast someone is doing well out of the company ;-)0 -
