CURRYS PC WORLD damaged fridge

I purchased a fridge from Currys PC World and arranged for delivery on Sunday 15th March to my new flat which I am not currently living in yet. I waited there all afternoon until 7pm but the fridge did not get delivered. I called Currys and was fobbed off with an excuse of traffic. Delivery was rearranged for the following Sunday with a time slot of 11.00 a.m. I informed Currys that I had to travel to my new flat to accept delivery. When I arrived at my flat the fridge had been delivered at 10.00 a.m. It was left in a communal area and a neighbour had signed for it.
As my kitchen was being fitted i left the fridge in its packaging until the following Saturday. Upon carefully opening the packing the door had a very deep round dent in the door.
I contacted Currys by email to report the damage and request a refund/replacement. I was informed that I should have reported the damage within 48 hours of delivery.
Does anyone know what my next step should be.

In law, you have a reasonable time to reject the goods if they don't conform to contract.
Even if a reasonable time has passed and you have accepted the goods, you are still entitled to a remedy - just you can't insist on a refund (where if acceptance hasnt occurred, you can insist on a refund).
if they tell you 48 hours again, remind them that misleading consumers about their rights can amount to a criminal offence and that OFT have taken action against companies who even gave 7 days to inspect goods - never mind 48 hours.
If you need something to back up your position, have a look at the unfair contract terms guidance provided by OFT under the heading "time limit on claims".You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -

the packaging seemed ok, they have offered 10% off the price. But now i would like my money back.

but , it has not been delivered to you , you hav,nt signed for its safe arrival , ask them to remove the damaged one and re deliver to the correct name/address , you will check the item , and if found to be in good condition , you will sign for it.
remember , they have not got your signature to say it was in perfect condition when delivered0 -

A signature on delivery means just that. That is was delivered. Indeed even a company having a "this is to certify the goods delivered were undamaged" (or something to that effect) is largely valueless for the reasons I mentioned above (that by law, you have reasonable opportunity to inspect the goods and any term or action by the retailer to restrict or remove your statutory rights is unfair and can amount to a criminal offence).You keep using that word. According to Currys PCWorld themselves, by getting a neighbour to sign for the delivery, they have breeched their own terms and conditions which clearly state that the person ordering must sign for the deliveryDo I have to be there to sign for delivery?

Thank you for your email dated 5th April 2015.
I'm sorry to learn of the problems regarding your delivery. The time slot given by ourselves is only there as a guide the text message received also states that the time slot is only an estimate and not an exact time slot.
Regarding return of your item, we would not do this as the item is outside on the 48 hours return time frame. It is the customers responsibility to ensure the item is checked upon delivery. As the item was left for 6 days this would take it outside the time allowed for return. This is all clearly stated in our terms and conditions.

1. The fridge was not delivered on the date given. I waited at my unoccupied flat until 7pm.
2. When I called Currys I was told they never knew the reason for non-delivery! A new delivery date had to be arranged.

3. The new delivery date was arranged for Sunday …..between 11am and 3pm. Currys were informed that I had to travel to the property to accept delivery.
4. The fridge was delivered on Sunday at 10am – 1 hour before the time scale that I was given by Currys. I was not at the property and the driver was unaware of any timescale of delivery. It was left in a communal area. I did not receive or sign for the fridge.
5. The fridge was brought into my flat and left unpacked in an empty room
as my kitchen was being fitted. The fridge was unpacked 6 days later. That was when I noted the door had a large dent.
6. Regarding your 48 hour policy for reporting damaged goods. In law I have a reasonable time to reject the goods if they don’t conform to contract (an acceptance hasn’t occurred). I would remind you that misleading consumers regarding their legal rights can amount to a criminal offence and that the OFT have taken action against companies who even gave 7 days to inspect goods.
7. I would like you to remove the damaged fridge and refund my money.
8. The service provided by Currys has not been of a satisfactory standard and for this reason I would request you remove the damaged fridge and issue me with a full refund.
