I've been taken to court!

Yeah I saw that before. Hadn't actually spotted its the same company! Hopefully my case will get "sisted" too then! Cant believe theyre still raising cases against people when they've already got this test case going on.
Does anyone have any advice on what to do if it doesn't get sisted?0 -
If you receive a formal claim, you follow the formal process to defend the claim. You DO NOT IGNORE real court papers.0
-
the advice to ignore them has never been changed because the evidence so far suggests they cannot be enforced in Scotland
that does not mean they wont try court, it means that as yet no court has found in favour of these companies (not enforceable)
there is a difference which clearly you did not see
anyone can take you to court for almost any issue, including parking invoices, does not mean they will win and so far they havent won as the cases tend to get dropped by the companies
therefore, not enforced
a few of them are chancing their arms and trying to break the duck , none have succeeded to my knowledge
they could be trying this on you as a test case , to test the water
if they lose, it would prove the advice given is correct
hopefully these companies that are being summonsed to court (like CEL etc) will lose and that could sway the tide against them all, including VCS
the unfortunate aspect for you was a newbie posting on the same day when CEL were due in court in Aberdeen meant that you were ikely a PPC troll , hence the animosity towards you (this does happen a lot, we have no idea who you are or why the post appeared)
its like posts today saying martians were ticketed in buckingham palace, do we believe it ? or not ?0 -
How about reverting this by writing to them one at at a time and saying you were not the driver, give them a name of the driver and address and they can send a new letter to them .
Then you can start the process again either by appealing or paying the small fine if you so wish!0 -
very silly to reveal the drivers details in scotland
not sure how they can appeal as there is no appeal process in scotland either0 -

Ignore this rubbish. Instead, contact trading standards and defend the claim as per the paperwork - DO NOT NAME THE DRIVER.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

If you were not the driver then that's the first hurdle they will have to cross. However if you were the driver it is not a good idea to tell porkies in any court.
The reason for your claim looks as with the others it was a multiple ticket case. These have always been more likely to be pursued. Defending multiple tickets is only slightly more difficult then defending one, as you can not claim you did not know about the conditions. However there are many other points of defence for you too employ.
Hopefully the case in the press article will kill them all off.0 -

But it would not be held against you if you said that you could not remember. You never know how far you can go until you go too far.0 -

Do you think if it is not true?
You are dealing with a court of probabilities, not fact. Ask Stephen Thomas!0
