BAd idea
You do not speak to solictors; only communicate in a way that is recorded. Also the solicitor who helped execute the will is employed by aunt and really should not be talking to you.
Ask your solicitor to copy them into any correspondence with your aunt.If you've have not made a mistake, you've made nothing0 -
Cheers Ras, thought it was a bad idea, yeah my solicitor said he is going to send those guys a letter aswell.0

Recieved the cheque, didn't notice it at the bottom of my mail box, weird the postman didnt get me to sign for it, anyway as expected £20000

As far as the Solicitors go, if their name is on the Grant then they extracted it for your Aunt. It doesn't mean that they have dealt with any of the administration for her, they may simply have done the form filling.
In any case, as you have instructed your own solicitor they will not be able to speak to you direct about it, it is a matter of professional rules.
Your next step will be to wait and see what is forthcoming from the letters your solicitor sends.:heartpuls Daughter born January 2012 :heartpuls Son born February 2014 :heartpuls

Again thanks for all the advise it's been a great help.0 -
So guy's i seen the solicitor yesterday he was pretty shocked at the story and what's going on.
The executor (my aunt) who i managed to call monday, her sister (my other aunt) who told me not to bother her again and to get on with my life has now changed her tune after my last message stating i would communicate threw a solicitor, she has messaged me today inviting me up to my aunts house (the executor) to see the copy of my dads will (I replied i have a copy of the will.) after not wanting to even tell me about the will from the start or even communicate with me, also stated she has all the stuff (dont know what shes referring to) and receipts.
Receipts are all well and good but still no mention of what he left etc, so im assuming they still don't think i have a copy of the probate.0 -
but still no mention of what he left
Tradzor
I understand your suspicions, added to by the fact that the executor has been uncommunicative. However, all that has certainly been coloured by whatever soured relations between you and your father+aunts in the first place.
The executor is now willing to meet with you, and you should welcome the opportunity to understnad more about the situation.
However, when you meet you should bear the following in mind:
(1) The executor is not obliged to keep you informed during the process of dealing with the estate. Indeed, they should in general be left to get on with sorting everything out without interference. It is only at the end of the process that they are obliged to give you, as a major beneficiary, a set of estate accounts showing the assets and debts of the estate, and how the final estate has been distributed.
(2) You seem adament that there would not have been major debts. How on earth do you know that, when you admitted in your earlier thread >>>> I had not been in talking terms with my aunts or my dad for years
You must therefore be prepared to acknowledge that you have NO IDEA what your father spenthis money on in the last years of his life. He might, for instance, have tried expensive treatments for his MS which were not available on the NHS. He might have taken a 'trip of a lifetime' before it was too late. Some such debts might not have been known by the aunt, and only come to light later, so the figures on the grant of probate could be wrong.
I hope you will get to the bottom of everything through meeting with your aunt, but go with an open mind simply to gather information to understand the situation. Please don't go in accusing your aunt of anything underhand unless you are Very, Very sure of your facts. There could be perfectly valid reasons for the things that at present are not easily understandable.
You are justified in asking the sort of questions you are asking. But don't jump to conclusions until you have a fuller understanding.0 -
Your absolutary right m8, but remember they also they took all belongings from my dads flat, the figures on the probate could be wrong but let me say this, she has the will and clearly knows whats on it. So besides the money it's no longer even a conculsion, what she has done is wrong.
But in regards to the money let me say this..my aunt handled all my dads monies, affairs for years and years, declared £3500 in liabilities/debts, I think she would of known about a £10k+ debt, not happen to come accross it within 1 month, extraction of probate end of january, my sisters cheque sent beginning of march, more or less 1 month after extraction.0 -
So said I would update you guy's..
My solicitor got back to me today, it appears they have realized they have been caught out, the executor my aunt, came up with an excuse about an intern payment or something, which my solicitor said was just a petty excuse more or less, and that she has tried to rob us.. he advised me that i could go to the police, but don't want it to go that far.
My other aunt now deleted her facebook, so !!!! has hit the fan with them, can't believe it really.
The executor's solicitor is now dealing with the estate and we expect to recieve our remaining money and my dads belongings threw them..
Never thought they would of done all of that, but suppose when money is involved people change.
The solicitor also said I could send letters to banks to see if my dad had accounts with them, as the solicitor advised me if she was willing to do all of that, there could of been more monies involved she didn't mention.0
