Can they chase??

I have got a problem with my SOL's:rolleyes: ( surprise, surprise )

They are telling me that my local authority searches are going to take 4 weeks to come back ( 29 aug ), this is after telling me that they take 2 weeks (they were instructed last Thursday)

I have called them to say that my sellers and me have young Children and that 1 of each of our children are starting primary school in Sept. Sellers kids school in another town. I was then told that that was the date they had been given, and they can't chase or help me with that in any way.

I have previously fought their corner on here after some bad remarks and now I am afraid that I am eating my words:confused: ( sorry Gwenrose ).

This is just the latest blunder in the last 6 days.

Please someone tell me that they can do SOMETHING at least.

    Why is it a blunder on the solicitor's side if the LA can't get their act together?

    They are targetted to return searches in 2 weeks. They must be busy. Call them up and ask if you were to turn up in person whether you can get them back quicker. Then ask your solicitor if that is acceptable.

    Sometimes getting things done quickly does involve legwork on your part.

    I have contact with them on a daily basis asking if there is anything that I can be doing to move things along. Everything that is sent to me is sent back the SAME day on next day delivery.

    I called last Monday and asked if everything is ok with additional enquiries would we be able to exchange contracts by the 10 Aug. I was told that " yes that is a definate possibility ". Obviously not as searches had not been applied for. I was under the impression that they had, noone told me otherwise. The next day I called and was told that they were waiting for a plan of sellers SOL, to apply for the searches. I got onto this straight away, only to be told that they had already sent 2 to them.

    I am happy to do legwork if someone tells me what to do.

    I was referring to my suggestion that you contact the LA when I said legwork. I wasn't commenting on what you are already doing :confused:

    I am worried how my Little Girl is going to cope with all the changes that will happen all at once.
  • Hi Dattasatta, give your local authority a call, find out when they received the instruction, how long they will take to be sent back and how they are sent back (dx, royal mail etc).

    If they are unaware of an instruction, it could be that your solicitors have instructed a search company to do them - in which case you would have to find out from your solicitor.

    Your little girl will cope just fine :) If she is young she will barely notice. They just want to know how their room will be decorated. Really.

    Our sols have now received our deeds from the building society and the redemption figure for the final payment, thank god, no more mortgage after 33years of paying.

    She has said the searches have been asked for and I am going to phone the sols tomorrow just to check what the state of play is. I know our actual sol is on holiday until the 13th August and our buyers are also on holiday until this coming Saturday, but they have paid for the survey to be done on our property, so it's just a case of waiting for their surveyor to contact us.

    Although our sols away we have been adviced that there are three others who have all the relevent details and can act on any thing that might need dealing with.

    I'm finding myself chasing the EA to get information on what status every one else is at, as they want to be paid they can jolly well work for it, if I don't get the answers I want I pay them a visit until I do, hate doing it like that, but time is no friend to me and we are the clients.

    I have also mentioned that unless they update us on a reqular basis, I will invoice them for the phone calls I have to make to their office:rotfl:

    Next week will be the turning point when every thing should fall into place.

    Me, I say chase them and just remind them who is the client and make sure the EA do some work like chasing sols, god knows they cost a fortune, let them work for it.

    To be fair to the sols, quite often there are delays in the searches, and its often not the fault of the sols. Most big firms use outside agencies to do the searches now, and some of them (like Searchflow) couldn't pull their finger out if their life depended on it. Add to that general local authority incompetence, and you get delays.

    People expect too much from conveyancing solicitors IMHO.

    I have waited 5 weeks for LA searches in the past. With the HIPS now, LAs have been told to get there act together. We shall see!

    Our area had 9 week delays on searches last year when we bought, nothing the sol's could do about it. I did phone and speak to the lady who did the searches, who was lovely, she also could do nothing about it.

    Your littley should be fine :)
