Dd named driver - responsible for debt?

    It looks like she will have to establish whether it was in her name or not. If it is, I will have to pay, and she will pay me back sometime (she is a student with no income), and this will be a lesson in not dating a**holes, and that insurances are legal documents

    If he was a learner more than likely in her name. I guess that she answered other questions (main driver, reg keeper) dishonestly too. So in fairness she was stupid and will have to take whatever hit she is given.

    Yes loskie she'll have to take the hit. In all honesty, though, she did think she was the named driver, as his payment details and car details were used, and I do wonder how he cancelled the policy, and why no documents have been sent here. Hopefully, Elephant will help us tomorrow. She has definitely learned a lesson

    Oh dear - heated discussions don't help.

    She has likely been played for a fool and she now needs your help, love, and understanding to learn from this and move on.

    Until you know the exact situation as to whether the policy was in her name as the proposer or not, there is little that can be done.

    Did she actually speak to elephant herself at the time the policy was taken out? Otherwise, the argument could be that the ex boyfrield fraudulently took out an insurance policiy in your daughters name. As you say she gave permission to be added as a named driver, not to have a policy taken out in her name - you cant have two car insurance policies in your own name can you?

    You can have as many as you want/need.

    Good comment except that yes, you can have as many policies as you want / need.

    I'd be looking at whether or not she'd actually agreed to be listed as the policy holder - if she'd given her details to be a named driver and he'd then mis-used them and taken insurance in her name then (at least in theory) she should be able to avoid all nasty on-going repercussions.

    The start has to be to find out from the insurers exactly who was policy holder, who was named driver, and the addresses etc given. Ideally that should be in writing (my cynical side says proper writing, not email that may appear to be from somewhere it isn't).

    Of course, you have to allow for the fact that an 18 yr old who's suddenly found herself in (what she'll probably see as) life-ending !!!!!! may not be telling you the truth, whole truth and nothing but the truth. Some will, an awful lot won't!

    As previously said you can have as many policies as you want. What you may be thinking about is that you cannot have more than one policy on a single vehicle. Otherwise it could be open to fraud with two claims with different insurers for the same insured event. This is though less likely now with the MIB database.
  • There's no fraud just because you have 2 policies on the same vehicle (unless there's dishonesty). You can if you really wanted to, though there'll no doubts be a clause in each saying that they won't pay/only pay 50% so there wouldn't be much point having it insured twice.
