Mine was the same as yours, read my threads, appeal and get it lifted it's free within 7 days, thereafter it it £35. Mine says the judge stayed it of his own Judgement. Also like yours it was in Manchester CC and was til 30th Sep 2008.
I won my appeal.

Had a letter this morning from Middlesbrough Country Court to state that my case is being stayed until October 2008 so not sure what post it was but the list can be updated with Middlesbrough now staying.
Very disappointed as Alliance and Leicester have made no attempt to submit anything prior to my court hearing which was the 7th of September while I've took the time to put together a court bundle and early judgement.
Thanks for the help I've had from some posters on here already, I'm very grateful for the help received even if it's been caught up at the wrong time.
I don't believe for one second that the test case is going to help anything in the favour of the consumer so I'm very disappointed.0 -
I was in Romford County court on Tuesday against the Abbey. There was about 10 cases agianst them and a few agaibnst barclays. Thier solicitor went to the usher and gave the names of the cases he was defending, he did not mention mine. When my case was called he stood up to enter court. I asked who he was and he said he represented ABBEY. I asked for proof that he represented the ABBEY for my particular case. He couldnt and thefore couldnt enter court. The judge gave me £1991 plus £120 court costs.
I had applied for intrest by was advised that would be another case and should take the money , which i did.

If they send a Solicitor DO NOT SPEAK TO THEM OUTSIDE as they will tell you they are applying for a stay and you are wasting your time.
Go into court and when they say they represent a bank ask to see the instruction. tHey are sending trianinees solicotrs with no paparrs just a brief to stay the case.

Hi everyone, i have got a hearing date for Tuesday 28th August at Gloucester County Court against Lloyds. I have today received a letter from SCAM stating that they are requesting a STAY, so I have just rang the court and although they have requested the dreaded STAY the judge as looked at the case and he has requested that it is still listed for an hearing. I'm not sure if this is good news or not we will wait and see....... I was wondering if anyone else had dealings with Gloucester court????0

I do not know anything about Gloucester but as the judge appears willing to hera arguments check the thread on this board on defending stays there are some good arguments. You mau have to read through some debate between me and Deary65 though.As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0 -
I had exactly the same thing shelly was told case would go ahead even though the bank had put in a stay but a few days before my hearing the stay was granted what a waste of time took ages to put together the court bundle too.0

HI, I AM NEW TO POSTING BUT READ REGULARLY TO KEEP UP TO DATE WITH WHATS GOING ON.
I NEED ADVICE MYSELF NOW.......I RECIEVED AN OFFER FROM ABBEY WHICH WAS 65% OF MY ORIGINAL CLAIM. I DECLINED SENDING THEM A COUNTER OFFER (WHICH I MUST SAY I AM GUTTED ABOUT NOW, BUT EH!).
I HAVE NOW RECIEVED A COURT DATE FOR 22ND OCTOBER. BUT I AM GOING TO BE ON HOLIDAY. CAN THE DATE BE CHANGED?
THE OTHER THING IS, I HAVE BEEN READING ABOUT PEOPLE TAKING THEIR COURT BUNDLES WITH THEM TO COURT, SOME SEND THEM 14 DAYS BEFORE THE DATE. WHAT SHOULD I DO?
I FILED MY CLAIM MYSELF ON MCOL. SO NOT REALLY SURE ABOUT THIS STAGE OF THE PROCEEDURES.
I CHECKED ON THE FORUM AND IT SEEMS THAT CROYDON COUNTY COURT, WITH WHOM MY CASE IS BEING HEARD, ARE DOING THINGS CASE BY CASE . I HOPE MY HEARING WONT BE STAYED.
IF IT IS.... DO I STILL SEND MY BUNDLE?

Hi All,
we have also received notification of a Stay pending the outcome of the Test Case, by Northampton County Court...following Abbey filing a defence of our claim...which is around £2300. We hadn't at that point been given a date for a court hearing.
We were thinking of applying for cancellation of the Stay using form N244...has anyone had any success yet using this??0 -

Hi Sparky I am helping a friend claim his money back he has a date to appear in St Helens county court on the 10th October at 2pm.
The letter states " Judge Barker has considered the statements of case and allocation questionnaires filed and allocated the claim to the small claim track.
I am helping him put his court bundle together but don't know whether I am waisting my time because Llyods will probably issue a stay and win it. Oh well will let you know the outcome It just seems we are all waisting time and efforts and the banks and courts are stitching us up yet again.:mad: :mad: :mad: :mad: :mad:0 -

Make sure you get your bundle together to include your bank statements and everything else you are relying on as evidence. Send a copy to the court in plenty of time of the hearing date (and definitely by the date requested if they have requested it) and send a copy to the bank/their solicitors.
When you go to court, take the 'bundle' with you and also prepare your arguements against a stay (you'll find loads of advice on the thread about that).
