i dont know if this is in the right place but can anyone help me.i recieved a letter today,20 aug, from manchester county court stating that of its own initiative my claim has been stayed untill 30 september 2008,it said i can apply to have this set aside no more than 7 days after it was served,the letter was dated 8 august! i dont know what to do now,should i resign myself to the fact that i will never see my money again??any help or advice woulr be greatly appreciated.0

Call the county court and see what they say. They should be ok with it. GL.0

The relevant date is not the date of the order which is at the bottom but the date at the top when it was sent. Inany event even if it is more than 7 days after the order was made you can still apply on a N244 for the stay to be lifted. I am not sure why the stay has been put in for that length of time effectively it is staying the case for the entire legal year. Arguments against a stay being i,posed are on threads on this site and CAG.As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0 -

Hi all:
I went into Caernarfon County Court this morning, just to check on the progress of my claim. I was told that all bank charges claims were being transferred to Cardiff and were being stayed. I will receive written confirmation of this fact within a couple of days. I am fuming because I asked the court for judgement because of abbey's non compliance on 13th of this month. apparently claims are being stayed in Wales, Devon and Cornwall across the board. More to follow I suspect.

Is anyone going to Manchester Courts on the 13th Sept? Have you heard anything from your banks about stays? I'm taking HSBC to court and have heard nothing yet, has anyone being before the Manchester judges since the ruling?

Hello no not Manchester but I had a Directions hearing date for 14th August,fixed before the 27th announcement First of all it transfered from Northampton to Newport and then again to Cardiff. It turned out there were 5-600 of us!! all for 10,30am !! On Friday 10th I received the court order placing a stay on the case as did everyone else!! we all took or sent in applications for the stay to be uplifted, as well as objection letters and letters to the MOR, MPs Rhodri Morgan, look over on Cardiff directions hearing site on the CAG. Judge Hickinbottom ordered the blanket stay himself, even though the Master of Rolls said that each case should be decided separately whether or not to stay, also the banks should apply for the stay for each individual claim with a cheque for £65 attached0 -
