Vehicle Control Services - Appeal Rejected

Hello all,

Having received a postal PCN from VCS on 27/1/15 and sent an appeal letter based on your template on 30/1/15, I have today received a rejection of my appeal as I 'did not submit it in time to be received within the time scale'. They are saying the issue date is 9/12/14 which on my PCN is the contravention date but not the issue date.

My initial reaction was to send a brief response pointing out their error with a copy of my postal PCN proving that my appeal was received within their timeframe but I remembered my first letter states I will not enter into any more correspondence with them!

So main question do I send my response and await their (100% likely to be a second rejection!) next letter or do I go straight to IAS?

(Also I did originally read a lot of the wealth of information on here and decided that they were not breaking any POFA 2012 rules, but now I am wondering if I made a mistake as I received my first noticed 48 days after the contravention date, although the letter states nothing about POFA 2012 or keeper liability so possibly not relevant.)

I did also complain to the landowner who said it was our of their hands.

    I doubt that you can go to the IAS as you have not been told you can do so

    it is likely that any VCS appeal and any IAS appeal will be rejected anyway, so I see little choice other than to go into IGNORE MODE for 6 years

    only come out of the woodwork if you ever receive a genuine LBC or a genuine MCOL

    A COMPLAINT to the DVLA would not go amiss

    if they are not using POFA2012 , then they can only pursue the driver, so depends if you outed the driver or not , if not then its one defence if it ever went to court

    you could point out in any reply that as RK you dispute the invoice and they should pursue the driver, who will not be named

    I believe that whatever you do it will fail, so IGNORE is probably the only option for the next 6 years anyway, despite anything else you may do in the meantime

    you have the right to defend yourself in court, if needs be, so keep the paperwork and use that right - should it come to it

    Does he/she not have another option, complain to the IPC?

    This is a new tactic by VCS. They state you can only appeal from 21 days from the NTD, so by the time the NTK is issued, no appeals are allowed. This is on the basis that the keeper was the driver, so they already have seen the NTD.

    You cannot complain to the IPC directly. The process is to complain to VCS, then once they complete the complaint process, you can complaint o th IPC

  • So in a nutshell, what you basically have to do from now on is not to be cowed by the inevitable chain of debt-collector's letters from the likes of Rossendales etc for the next 6 years. Initially as unnerving as it may seem to do so, just ignore the buggars. They are attempting to terrify/intimidate you into paying what is in actual fact, a purely speculative invoice. Now although no shame of debt seems to the de rigour approach these days, there is a stark difference between actual legitimate debt and people trying it on for personal gain. The private parking companies love to take the mick by trying to lure/intimidate you in via spurious and often illegitimate means, such as the ubiquitous 'debt collector's' letters. These correspondences carry absolutely no legal weight whatsoever when issued by a PPC (PRIVATE PARKING COMPANY). In many instances, the PPC and debt collector (or pseudo-debt collector) are one and the same, and should be ignored accordingly in instances such as yours. The world as we elders know it, has changed. The old rules of fair play and owning up to your misdemeanors are completely out of the window. The private parking thing has now just become a case of who gets the benefit of taking the !!!! out of who. Yes there'll be forms to fill. appeals to process etc etc, but if you don't do it, they win. Life isn't fair, yet I wouldn't have it any other way, but what grates is that these chancers are playing upon people's fears, especially those who are older and whom are more respectful of their obligations. Sadly, this has now gone out of the window, and what we are left with, is a 'what can we get from you without being locked-up' approach from these PPCs. Therefore, I would never, ever advocate paying a penny to these shysters.

    I have ignored VCS's correspondence since as it is littered with errors, wrong dates etc...

    I did complain to the DVLA though and to my surprise they seem to be taking this seriously. They have asked for all our correspondence. I will keep you posted...

    To be fair pogo, this poster is not asking for help but merely relating to the OP that they've encountered the same issue, and advised what they have done. As such it is entirely relevant to this thread.
