PiP - is the entire claim looked at during MR

If one gets higher rate living component, and only gets few points on mobility, if one asks for a MR is the entire claim looked at again or only the section you object to? And during a MR can you lose all your entitlements (worst case scenario) or can that only happen if you take it to a tribunal?

So basically these guys can kill off all my sister in laws entitlements she got 14 points for DLC, and for mobility 4. So, basically she pretty much can't get to work since she really wanted to get the mobility component so she can get on the motability scheme, and work.
Do you think she's at a risk to lose the DLC if she's scored 14 points even if she does ask for a reconsideration?0 -

As I have said before on another thread, Decision Makers have their own way of looking at things. It all depends on who looks at the case. Some are lenient, some are strict and some look to see what is fair and reasonable.
So yes they could very well remove ALL of the points or give more. You do have the right to appeal against any decision though.
Why can't she work? Does getting a Motability car stop her? How? Why?
Most people buy their own vehicle. Motability has already lost it's edge with the expectation of regular reassessment of a PIP award. People are now buying their own cars as they don't want to risk the loss of a Motability one after a year or so0 -
Motability is a 3 year lease so not everyone who is awarded the enhanced motability rate is eligible for acceptance onto the Motability Scheme anyway due to the length of the award. If she needs transport for work it maybe worth looking at Access to Work as if all she has scored initially is 4 points the likelyhood of enhanced rate with a lengthy enough award looks slim.0

cant she get the bus to work?
if she currently gets the Enhanced daily rate living component of £81.30 per week (£325.20 per month ) could she not put that towards some of her travel to work ?0 -

Exactly. I once heard of a case where the DWP sent an officer to a tribunal over an appeal regarding PIP. When the claimant was asked why they were appealing and looking for the enhanced rate of getting around, the DWP officer commented to the hearing that it was more likely than not that they were after a Motability car as that seemed to be the reason for most of these appeals! Not surprising hearing that, they ruled against the claimant.
Besides which who on earth would want to take on a hire car with no idea how long they would be allowed to keep it. Buy you own and be independent.0 -

Her award is for over 3 years.
I don't know how she manages her finances, but she can't use public transport she was stabbed multiple times, and robbed caused her internet injuries while she was coming back from. She was a total wreck after the attack, and was on ESA but stopped her ESA claim(she ended it early she was in SG) as soon as she got the courage to get back to work. In all honesty if that was me, I won't have gone back, I would have been asking for more money, and a bodyguard. Before I left the house.
She said she wanted the car for a couple of months until she could afford her her own and she would stop her claim, she does not want to borrow money even a car even though I've offered her my own (my dad bought it for me) E63 Merc AMG which is over 70K she said its too fancy. I think her husband might have to come back from Pakistan if unilever give him time off from work.0 -

as much as i can see where you are coming from the DWP will not see that as an enough of a reason just to award her a mobility car PIP is based on a persons needs not what they want0
