Argos: 3 month old washer - Argos want £150 call out or an extended warranty

Just called Argos about a faulty washing machine we got from them 3 months ago and doesn't spin or drain.

Argos customer service said "It's £150 callout charge or if you buy an extended warranty you won't be charged"

Am totally mistaken that the 12 month warranty should cover this?

    Or ring Argos back and say "I'm not invoking the warranty; I'm claiming my legal rights under the Sale of Goods Act. Within 6 months any fault is presumed to be inherent unless proven otherwise. So please come and fix my machine, or replace it, or give me a refund".

    But ringing the manufacturer may be quicker. (Assuming Argos haven't contracted out the warranty from the manufacturer).

    Things like this really pee me off! She either lied or isn't fully aware of the SOGA.

    Why should they? Argos sold it, were paid for it and are legally bound to deal with it. End of!

    Of course you are correct, but it can often be quicker and less painful dealing direct with the manufacturer. :)

    But presumably Argos could insist on the OP returning the WM to a store, I doubt whether SOGA requires them to visit a customer's home. That may be why they want to charge a call out fee, although £150 is grossly excessive.

    I'd agree with contacting the manufacturer in this case.

    Is it possible that they said there may be a call out fee if it is found to be misuse rather than there will definitely be a call out fee even if it's covered under warranty/SoGA.

    Whenever I've had to have things repaired I've always been warned that there would be a charge if there's either no fault found or the fault is user damage/error.

    grant v electro centre might be relevant (while not case law, it can be used to back up a viewpoint/be used as an indication of how another small claims on the same basis might be seen).

    Basically electro centre refused to repair a dvd player that broken within a year unless the consumer paid to return it to them.

    So if they were to insist on a WM being returned to store, they would be the ones that would need to pay for its carriage.

    I also agree with contacting the manufacturer, but it is worth mentioning that SoGA S48B insists that:
    (2) If the buyer requires the seller to repair or replace the goods, the seller must—
    (a) repair or, as the case may be, replace the goods within a reasonable time but without causing significant inconvenience to the buyer;
    (b) bear any necessary costs incurred in doing so (including in particular the cost of any labour, materials or postage).
    Note in particular point (b) above.
