I don't really see why either one of you has more rights to the house than the other.
You can move back in if you wish, if may prompt him to move out quicker, but I would consider staying with your daughter a little bit if you really can't face moving back home.
I'm not sure why he has to sleep on sofa tho, you could alternate?
I wouldn't rule out looking for part time work, have you always worked but not recently, could you look at a small local part time job to get you out and meeting people?
You don't want to be house bound and eaten up with your husband having an affair.
I would speak to your land Lord, explain the situation. Seek legal advice if divorce is what you are both looking at, or look at therapy if that is what you both want.
You don't need to sort everything soon.Forty and fabulous, well that's what my cards say....0 -

Good point but there's a judgement call about timing and the content of the conversation. Many private landlord's will not appreciate being sucked into the tenant's personal problems, they just want the rent paid on time and repairs reported.
However, the OP may want to end the tenancy or take it over in her sole name so won't have any choice other than to communicate with the landlord.
There's nothing that a landlord can do directly to get her back into the property. If a joint tenant refuses to let the other tenant back into the property it may be a police issue or perhaps council issue if they have a private housing officer, for example, who deals with tenant/landlord issues.
There's a possibility that the landlord may be sympathetic to the OP and happy to end the tenancy in joint names and issue it in her sole name.
To do this, the landlord has to be happy to accept the risk and issues of having an unhappy tenant in the property who may refuse to leave or trash it when served notice.
Also, though the OP hasn't said this explicitly that she isn't in employment, if she is on benefits, the landlord has to be in the minority of the profession that are happy to accept benefit claimants as tenants and that she can afford the rent on her own. I'm not sure HB would stretch to cover the cost of the house if a claimant is entitled to a 1 bedroom Local Housing Allowance rate, for example.
Different process for social housing though.0 -
Or she does. Being female doesn't increase rights real or perceived as these forums seem to think at times
