Csa and Bank/Savings Account?

    As I understand it, that is the process. You are right.

    But if the person with the debt either refuses to pay it off at a reasonable rate or proves untrustworthy by failing to keep to the agreement, what then?

    As you almost certainly already know, enforcement action is taken only in cases where acceptable arrangements either cannot be made or have been made but not complied with.

    I'm sure you don't mean to suggest that the acceptability of an instalment arrangement should be a matter for the judgement of only the person who owes the debt.
  • Hi guys sorry I haven't had time to respond on here. My understanding of it all after speaking to him yesterday is that his payments are up to date without any issues. It seems like in the past he has earned more money than they (csa) know about or the ex partner. Although his history is quite bad really the child is 10 years old and the ex doesn't allow access because unfortunately she is one of these witches who can't seem to grasp the importance of having a father in their child's life.

    So basically he is in process of taking up another job soon (may time I think) and he is thinking about declaring it properly with the csa so it's all legit although I can see why he hasn't before after all he doesn't get to see his lad so why should he give that woman anymore money.

    The conversation then led to the fact that he has managed to save some money up over the years due to working so much and was thinking of investing it in an isa or a bond... but by doing that it is naturally tied up for a number of years and if the csa one day found out about the extra work he had done in the past and wanted their portion would they then be able to just take it from his bond or isa (what ever he chooses).... ?

    Certainly what we don't have is someone who has not been paying anything at all or ignoring it.

    That questions remains a 'live' one as I have been unable to really find out fully on his behalf... naturally has can out some money into instant access savings accounts in his families names if need be and keep some cash at home I suppose but I think he would prefer put it in a proper savings account with interest and in his name.

    What you have is a man purposly duping his own child and the csa into his earnings.

    A very noble gesture that he now wants to become'legit'.

    Clearly 'that' woman cant be that bad as he hasnt attempted to gain custody has he?

    Money will be taken from personal accounts, even if joint accounts. They will do this even if you are unemployed and have no money. You can then appeal for the money to be returned.

    Money cannot be taken from business accounts.

    Surely they won't put people into an overdraft situation will they? Or have I misunderstood?

    All case officers have access to customers credit records. It's used for negotiation purposes when arranging arrears repayments. The agency can impose a deduction order without a case being to court
    This is where they ask the bank to take money straight from an account or bank held credit card.
