Parking Eye Court Case

My family went to leisure world at Southampton but Parking Eye have taken over the car park. We didn't know that you had to validate the cinema ticket and I was sent a Parking Charge Notice as the owner of the car.
I checked on line and the car park is advertised a free for 4 hours for cinema users. the car was on site for 2.
The short version is I told them that I didn't think I should pay and they have sent me a court summons.
My defence is based on that I was not the driver but I think the Protection of Freedoms Act 2012 makes that immaterial. I have also based it on the fact that as it is free for 4 hours they have absolutely not suffered any loss.
They have sent me a 47 page reply to my defence based on a previous judgement by HHJ Moloney QC who apparently ruled in their favour on another case. This other case is where two guys overstayed the free two hours.
We did not overstay the free 4 hours but simply did not know about this ticket validation.
I need details of a case where Parking Eye have lost or any other advice on a way forward.

could you either repost this in the sub-board for parking or could a mod move it.
It will get more attention that way.
Meanwhile, please read the stickies at the top of the sub board - these answer most of your queries.Under no circumstances may any part of my postings be used, quoted, repeated, transferred or published by any third party in ANY medium outside of this website without express written permission. Parking Eye are a nuisance. A number of years ago they took over the running of the local Aldi car park. Parking was free and suddenly on a Monday the parking charge came into force. Drivers were allowed 3 hours free parking. I got caught in the first week and was given a £70 fine. I contacted them and told them my car is registered disabled, after which the fine was rescinded. I still do not know how long disabled drivers can park for as it does not give any indication on the sign (which is on a side wall of the supermarket, out of the sight of unsuspecting drivers).
2 weeks ago the limit to parking in our local Aldi car was cut in half to 90 minutes! Again this was quietly done during a weekend. They are obviously cashing in on unsuspecting drivers, robbing b******s.
I bought a new car 2 years ago and got sent another fine. They soon backed off when I gave them the details of my previous vehicle.0 -
Do you have the cinema tickets? Payment receipt? Send them copies pointing out they suffered no loss.
From there on they can't win so might as well drop.0 -
I've moved your thread over to the Parking sub-board so there's no need to repost.

bear in mind that Moloney case was actually the Beavis case which has just been to the COA and a judgment is expected soon
plus that docks area is supposed to be non-relevant land so was under review by PE and the DVLA too0 -
Google parking prankster. For the price if a coffee he does a guide to defending court cases particularly Parking Eye.0
