Property off the market but still on the website

Hey guys my offer was accepted last week and EA told me they weren't going to show the property any more. I was clear right from the start that I wanted the property off the market. They told me once the survey is booked they'd take the property off the market.

Survey was booked last week. Yesterday I saw that the property was still available on Zoopla so I rang her and asked her to either add 'Under Offer'/'Sold STC' tag or remove the listing. She said it would take about 24 hours.

Today I can see the property is still available on Zoopla (haven't checked rightmove but it's probably on there as well). I rang them earlier and asked why it was still there. EA said they had problems with their email so emailing the website companies was an issue. She told me it would be done by tomorrow.

Having had someone outbid me in the past on another property, I am being cautious and not exactly happy that it's still available on the site. EA did tell me they weren't showing the property anymore last week. But it's hard to trust EA and if a higher bidder comes along I'm not sure if they'll not accept the offer.

If it's still available tomorrow, should I give them an ultimatum?
Should I get something in writing/email to confirm that the property is off the market and they are not showing anymore?

    Get someone to phone up and ask about the house and see whether they are told its gone.

    I wouldn't give any ultimatums unless you are prepared to walk away.

    You can always start viewing other properties with the same agent...
  • as above, get someone to inquire and see what they say

    Sometimes agents use good properties as a bait to take details of potential clients on their books, this has happened to me, they start off by taking your details only to tell you they are not taking any more viewings for the property (very annoying).

    I will get someone to call them and ask about the property.

    So no need to get something in writing/email to say the property has been taken off the market? Could something like that be legally binding?

    Edit - I have already paid for the survey, MA and half of legal fees (both of these are no purchase no fee services) so don't really want to look at other properties.

  • Have they sent out the sales memorandum?

    I would insist on it being taken off but not make a huge deal of it at this point if you confirm they are not doing more viewings.

    Yes they have and I have a good working relationship with the EA so i don't want to be too demanding and !!!! her off but at the same time I want to minimise the chance of someone else outbidding me.

    She did confirm that they weren't showing the property anymore (but nothing in writing/email) but it's hard to trust EA companies!

    I did receive the memo of sale today! Is this sufficient?

  • Keep an eye on it, give it a few more days and then inquire again I'd say.

    Still doesn't guarantee anything. There was a thread recently where offer accepted and confirmed by EA in writing, only to get a call advising that someone 'who previously viewed' had suddenly put in a higher offer.

    Trust nothing until exchange. It may help, but nothing to stop EA ringing around to see if anyone wants to offer or the vendor changing mind, taking off market etc etc. Also could just be a technical hitch.
  • It's annoying but it isn't the end of the world as long as they aren't showing anyone around the property.

    When we bought our house the EA still had it listed on their website two months after we had moved in. I had to chase them quite a bit to get it taken down.
