eBay Unpaid item-DEBT COLLECTION AGENCY

    They want to frighten you into paying, all they have is scare tactics. They won't be taking you to court. If you were in Germany, I may advise differently but they certainly won't be taking action in another country for such a small amount.

    As far as the legalities go, I would have thought that not paying would be considered cancelling. OP only has to say he sent an email asking to cancel, the seller doesn't dispute that goods were never sent. From my little knowledge that would mean, unless it was a time sensitive item, that they could only claim for a shortfall in a subsequent sale.

    I paid them. Just couldn't rely on eBays help on this. As there is nothing they could do.

    I am a student and I can't afford a lawyer, in case I'd need to. So I'd rather pay those 70 euros and be done.


    I know a lot of people will judge me for paying. But honestly I couldn't even sleep at night. I was calling eBay at 3am to get some comfort.

    I don't want any debts, I don't want to owe anyone anything. So I just couldn't gamble for 70 euros.


    This is what I responded with to their email after paying:

    A sum of 77EUR was transferred to the account indicated below earlier today to:

    IBAN: DE50 2655 0105 0000 2464 47
    NAME: Mediafinanz AG
    ADDRESS: WeiBe Breite 5 D-49084 Osnabruck

    Please allow 5 days to a week for the money to be transferred.


    As of this moment I consider this issue to be settled.
    I am doing this for my own peace of mind, I do not acknowledge this “debt” because no such debt exists (as I do not have the said item in my possession), I had every right to change my mind under distance selling regulations, nor did I violate any eBay policies.


    I expect to not be contacted by you again. And I do not want the item!

    Thanks.

    Well...I don't want the item really.

    One thing I will be doing for sure is closing my eBay account as soon as this all settles. Done with eBay for good.

    Tell them that you will pay the €19 and then immediately invoke your DSR rights, which means they will then have to refund your money. Or they can cancel the order and call off the hounds.
