Jet2 excluded compensation under NeBs

Hi everyone,
I am looking for some advise on which my jet2 flight was delayed on 02-09-14 from Dalaman Airport to Manchester Airport, with the scheduled departure time of 22:25 (Flight number LS922).
We were ready to take off when emergency services had to come on and take the pilot off due to illness. A replacement flight arrived after an overnight stay in the airport and we arrived 7 hours late at Manchester Airport.
I used the template from this site to claim compensation and received the following letters, a confirmation letter acknowledging my correspondence, then a letter saying I could not claim for the other party even though I was the lead passenger and my card was used for payment. A final letter was received stating that under the extraordinary circumstances published by NeBs paragraph 16, my compensation claim is excluded.
Can I contest this or should I leave this one alone, any advice would be appreciated.
