Excel Parking Charge Notice in Swansea

Hi There,

New to the forum so hope this thread is in the right place.

I had a PCN from Excel back in December 2014 in Swansea. The car park in question has no signs on entry to the car park I entered to say you have to pay and display etc etc. I returned to the car and there was a windscreen PCN but I waited until my wife received the postal notice, which said I had 28 days to appeal. So my wife at the RK diligently used the appeal template from this site to appeal (thanks coupon-mad) but today she received a letter from them stating that the appeal wasn't received within the 28 days from the issue of the ticket on the windscreen on 20th December. Is this correct, should she have appealed at the windscreen PCN stage as I read on this forum infor that said to wait until they write out to you? Or are they just empty threats as the letter she received said she had 28 days and it was issued on 29th January.

she just chedked and the letter they wrote to us stated we had 28days from issue of that letter on 29th January to appeal!

I'm confused please can someone help?

    Same as the advice given in the thread about Care Parking on page one right now near this thread. The keeper could appeal and was not too late.

    As this PCN was from December it was when Excel were in the BPA. So your wife as keeper, should complain to the BPA that she should have been sent a POPLA code (do not mention 'waiting for' the NTK, just talk about getting a NTK and appealing in time).

    Never name the driver to Excel as they don't use a Notice to Keeper than can establish keeper liability under the POFA - with their choice of wording since August, they can only hold the driver liable - so don't tell them who that was, be careful with all complaint wording.

    So should I send a letter of complaint to the company or shall I just go straight to the BPA now and ignore Excel? Do I email or send a postal letter to the BPA?

    Also could you link the Care parking thread as I can't seem to see it:-)

    Is there a template I use or do I just tell them as you said that I appealed within the timeframe but received no POPLA code? What will be the outcome of this?

    Put 'Care' in to the box 'Search this forum' and see how easy it is to use that facility to find anything you want, specifically, rather than staring at thread titles and clicking randomly on them. Much better to be able to do that than ask for links.

    'Search this forum' is just along on the right back on page one of this forum, above the threads and level with the blue new thread button (NOT a 'tab' at the top).

    No template for a complaint - two lines is all your WIFE needs to make her point (remember this complaint comes from the keeper, not mentioning the windscreen PCN). Plus attach a copy of the Notice to Keeper and the appeal she sent and the rejection letter, because the BPA will ask for that. Remind them the 'parking incident date' alleged, was from when Excel were BPA members!

    How long will it take for them to get back to me and what will the outcome be (e.g. will they issue me a POPLA code or will the PCN be cancelled)?

    Outcome will be one or the other of those 2 things. Sometimes they come back within 2 weeks, sometimes longer.

    and my wife as RK doesn't need to write to Excel now stating she was within the timeframe to appeal the NTK letter and that she has complained to the BPA as Excel were with BPA in December when the original PCN was issued (as stated on the letter we received this morning from them saying it was originally issued on 20th December 2014)?

    No need to write a special letter but she could include their email copied into the email being sent to the BPA as it wouldn't hurt. Their email is at the foot of all their headed letters.
