Jet2 latest excuse

Our flight from Arrecife to Newcastle on 28/09/2014 was due to leave at 21:00 and was delayed until the following day due to a technical fault. Jet2 have accepted a technical fault occurred but are now saying that the delay exceeded 3 hours because the airport closed for the night or another plane could have been re routed. As the part was flown out from the UK it could not have reached Arricefe before the airport closed anyway but they are standing firm.
Has anyone come up against this excuse and how can I challenge it please

Issue NBA then go to court. Its the only way with Jet2.

I'm a newbie JPears so apologies if I should have posted on a Jet2 thread (is there a link or how do I find it please)
I'm considering legal action now but just want to know if I still have a strong case, they're quoting a flight safety shortcoming (ie the airport closes at midnight) as the extraordinary circumstance......letter tennis at its best ......any opinions?
