UKCPS unable to consider appeal

I have appealed against this pcn from November, I waited for the notice to come to the door as advised then appealed as per the newbies thread, I have now received this letter

    What date was on the Notice to Keeper?
    What date did you receive it?
    What date did you send your appeal?
    Did you get proof of posting (or email receipt if sent electronically)?

    They won't take an 'observed leaving site' to court while VCS v Ibbotsen exists!

    Oh, and your thread title is wrong, it should say 'UKCPS UNWILLING to consider appeal'!

    There is no prescribed time limits for appeals, only recommendations. They can consider an appeal anytime if they want to.

    I received the exact same letter after an appeal - looks a standard computer generated rejection after they ignored the initial letter past the 'appeal' window for the IAS.

    Depends if you both appealed as registered keeper not driver? If you sent an appeal that in any way admitted who was driving that is a big mistake. It's why the template is written without any words about what happened.

    If you appealed as keeper then you could either:

    (a) respond and say so but tell them you will not be using the IAS* and if they think they have a case they will need to take the matter to small claims. You could add that you are aware that IPC firms have to win 80% of IAS appeals and such a 'target' leads you to lose faith with the system. Hence you won't be paying but the driver will not be named, and if they try Court you will show that UKCPS refused to consider an appeal properly.

    (b) Leave it, don't reply. File any letters - unless you get a small claim and then you'd be able to defend it properly. UKPCS lose many cases on 'signage issues' so get pics of the signs at the same time of day and a close up of the wording which is useful for any defence in due course. People do beat UKPCS although not every time.

    Those who lose just pay about £150 (no CCJ, no effect on credit rating if you pay after the hearing). Those who win pay nothing and there are UKPCS examples in post #5 of the NEWBIES thread (all about small claims).

    UKCPS don't issue court papers for every case (more likely perhaps if a disabled bay case). If it were me I would chose (b) now because if you choose (a) they might then offer IAS and then paint you as unreasonable in a future claim, because you didn't use the 'ADR' offered!

    Sorry to thread jump CM, theres no identity of the driver, it was a NtK we got and appealed. They are a bunch of cowboys even the management company guys I saw today were furious with them, hopefully we can get them off the premises and stop them harassing innocent motorists.

    Reading it is almost impossible. Host it on Tinypic or Photobucket.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(
