restrictions by air traffic control

I put in a claim for flight delay compensation to Iberia. In their reply they say there were extraordinary circumstances out of their control namely restrictions by air traffic control. Is there any way I can check whether this was in fact true for my particular flight.

Sorry I don't know how you'd check that. Maybe someone else can help. You might try a no-win-no-fee solicitors, Botts are getting a lot praise on the forum, maybe their data base will have the answer.

Very good idea. It would also seem on the face of it to be a matter of getting hold of the ATC records from the airport/ATC centre of whichever country it was. Not an easy task.
What you might consider is a "Notice before Action" (NBA) letter to Iberia saying you require details of the ATC delay or you will issue proceedings (if you haven't done this before it is really quite easy). The Court will then require them to cough up details and proof.
This will cost about £40 to get the ball rolling.0 -

Or £40 well spent when it is proven Iberia were 'trying it on'!
What is it they say 'speculate to accumulate' cost me a £60 court fee, but received it back! All the airlines try it on...
