it was the work programme advisor and each week he kept telling me to write to them to tell them about change of meds and condition, now i wish i hadn't listened to him, he said hes the advisor and thats the advise i should take, do you think they could take the points away the court gave me.which advisor?
the one at the job centre or the work programme one?
to be honest, it is only essential to tell them of a change of your condition has improved, unless it meets one of the support group descriptors.
the fact that you had significant issues in receiving ESA in the first place should have been a warning that unless you felt certain that you met the support group criteria, then it would be better to leave things alone.
you cannot be mandated to do things on the work programme if they are detrimental to your health.
have you actually looked at the support group descriptors?
i am very worried about it now,0 -
it does look like they are going to reassess you.
DWP make the decisions and they will have looked at your request before passing it on.
did you tell them why you felt you met the support group descriptors and send any evidence to back this up?0 -
i sent a letter from the doctor who stated i would be better in the support group he felt, and said my advisor had told me to write, i feel like this is the advisors fault for telling me to write to them, i am really worried now, and what happens now if they find you fit for work is it still in assesment group and then court againit does look like they are going to reassess you.

Are you aware of Regulation 35(2) ?
http://www.benefitsandwork.co.uk/news/2955-regulation-35-2-b-is-now-the-main-route-into-esa-support-group
Get a strongly worded letter from you doc or consultants mimicking the words " there would be a substantial risk to their health or someone else’s health if you were found to be capable of work-related activities" and you might be accepted into the support group0
