District heating standing charge: landlord or tenant?

    I only mentioned court interpretation because in deciding what it is fair to expect, or ask for, it is useful to know (if possible) what a court would be likely to decide.

    I'm not suggesting this should go to court!

    Tricky one I suppose. Personally I think it would be fairest to split it partially with the landlord and tenant. Perhaps you could work out what the typical standing charge is on a normal gas/elec tarrif and you pay that (eg £100 per year) and you pay the usage on top. Landlord covers the rest of the annual fee.

    I don't see how this is any different to any utility bill, which includes a fixed charge element for the infrastructure and a variable element for usage - you don't expect your landlord to pay for line rental on a phone line do you?

    Exactly.

    and 6p per KWh for hot water is cheap, if you didnt have that you would be paying 14p for an all electic flat.

    If the landlord pays for the £400, will you give him the 8p difference in usage costs?
