IAS decisions at a real court

[FONT=Times New Roman, serif]Has anyone been taken to court by a PPC after the IAS adjudicator has refused their appeal?[/FONT]

[FONT=Times New Roman, serif]If so, have they shown the real judge the kangaroo court's .decision, and if so, what has been his/her comment?[/FONT]

Are there any such cases in the pipeline?

    I would like to add , has anyone (as above) and asked the judge to find who the "mysterious" barristers were that denied the claim

    I have often said that if an IAS "adjudication" makes an appearance in a real court the defendant should request it be disallowed as evidence on the grounds that it is anonymous.

    I've been in court a couple of times where an adverse POPLA decision has been brandished by the claimant's representative.


    Judges have dismissed it as non-statutory and therefore irrelevant, and taken a similar stance with the BPA Code of Practice.


    I doubt that an IAS adjudication would get anything other than short shrift.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx.     Perhaps a cheeky defendant in possession of a typical disregard-the-facts-and-the-law IAS adjudication could include it himself as evidence of the claimant's bad faith!

    Here are some of the more bizarre rulings it would be interesting to put in front of a judge.

    "There is no case law on this yet as the statute is too new so I will not make a ruling"
    "This does not apply because of [quotes legislation long since superceded]"
    "A contract can be offered and accepted by driving past at 30mph, even if the motorist cannot possibly read all the words"

    and my personal favorite
    "The onus is on the motorist to prove their case. The motorist did not provide evidence of signage"
    ...from an airport where the only way to get photographs of signage would be to...er stop

    If I was to receive an ipc ticket any so called ias reply would be greeted with a barrage of complaints, together with a put up or shut up letter to the ppc and landowner
    From the Plain Language Commission:

    "The BPA has surely become one of the most socially dangerous organisations in the UK"
