  • Once you are in the self-assessment system, it is not always easy to get out, and information given via the phone does not always get recorded in the right place. If HMRC continue to send requests to file, you must do so or face the consequences.

    Other self-employed posters on here have been fined because although they may have notified HMRC that they were no longer self-employed, they did not complete the Date Ceased Trading field on the actual tax return. If you are sure that you completed that date field, perhaps they are still interested in you because you have no apparent income sources. There are boxes in the return that you can use to explain these things to cover yourself: did you complete these boxes?

    Well that was easier than expected! Fine cancelled! Last night I sent an email to the HMRC office that I emailed a while ago. I thought it was worth a try although I half expected to be told to go through the official appeal process....this is the reply I got this afternoon:
    Thank you for contacting Customer Operations - Pay As You Earn and Self Assessment.

    Please accept my apologies for the problems you've had when trying to deal with your self assessment.

    I can now confirm that I have cancelled the £100 penalty you were given for the late filing of your tax return for 2013 -14.

    I can also confirm that you have been selected for the completion of the 2014 -15 tax returns but you can ignore this one as I have already nil charged this for 2014 -15. So although it is to late to cancel the issue of this, you will still receive the tax return but you do not need to send this in as it has been logged on your record and I have now ceased your self employment so the last tax return you will receive will be 2014 -15 but this is already completed as a nil charge.

    I'm a retired IFA who specialised for many years in Inheritance Tax, Wills and Trusts. I cannot offer advice now, but my comments here and on Legal Beagles as Sam101 are just meant to be helpful. Do ask questions from the Members who are here to help.
  • Everytime you contact hmrc there is a evidence trail, if you called them or fied onlinethey will know that. Write a letter and explain yourself and if it all checks out they will remove the penalty.

    Great to hear you have cured your problem with HMRC. As you were in the States during 2013 have you filed your 2013 US income tax return yet, or is that also late at this stage?

    Again, without going into personal details - No US income.
