Unincorporated Charitable Association- members?

Hiya

How many members do I need to set up an Unincorporated Charitable Association?
Can they be my family members?
what effect does in have on them in terms of tax etc?
what risks are there for them?

    Get advice from your local volunteer organisation: google volunteer plus your area. You may find resources on their website, if not google Unincorporated Charitable Association and you will find other volunteer organisations which have some information.

  • We started off as an unincorporated charitable organisation. We had 6 trustees - from memory I think 5+ was considered desirable. No tax implications as non profit. Once we raised our first 5k we registeered for charitable status at which point the charity needs to register with HMRC. There should still be no tax implications for trustees if you are not taking any payment from the charity. You could also consider being a CIC. Gov UK has loads of info and model constitutions you can download.

    IIRC You can register with HMRC as "charitable" even if you do not meet the charity commission's threshholds, (so you can still claim back gift aid on donations etc) but they will need to see the constitution.

    A clutch of trustees with the same surnames and addresses might raise some suspicions.
