Accident Claims Management Fraud

Need some help very upset had a accident end of december.and was recommend a company in blackburn who came and took the car on a trailer and was given a courtesy car vauxhall insignia like for like after 8weeks we have recieved a letter say the third party disputing the claim and they no longer pursuing the claim, and have invoiced me for £5,422 for recovery and storage plus £30 a day hire charges, been told until we dont pay up our 2009 car will not be realised. requested all agreement papers nothing for a over week now. Anyone know who i can turn for help as the whole family is depressed :(

    Sounds like standard stuff, 3rd party insurer wants 50/50, the letter is threat and most people just bend over and take it.

    Hold their car hostage until you get yours back, you may need to hide it.

    Did you report the accident to your own insurer?

    You need to check what you agreed with the accident management company. Why was a hire care required for 8 weeks?
  • If you have have signed a credit hire agreement for the Insignia you have at the moment, on paper you are liable for it.

    As for the recovery & storage charges, have you signed any papers for storage of your vehicle at an agreed daily rate? If there is no consumer credit agreement for the storage fees, or other contract signed, they are on shaky ground.

    Odds are this company are overseen by the legal ombudsman if they have a claims management regulation authorisation.

    What is the actual situation with the original accident? What actually happened?

    Read the agreement. Accident management companies usually state that, in the event the 3rd party don't pay 100% of their bill, you are liable for any outsanding (inflated) car hire costs.

    How about contacting the TP insurer to see why they are disputing liability?
    Can you involve your insurance company if you are fully comp?
  • You should have read the paperwork which you would have been asked to sign when the hire car was delivered. Ultimately, the cost of hire is your responsibility. If they make a recovery from the third party, it's all good and you have nothing to pay. If they fail to make a recovery, you're responsible for payment. There is no fraud. You should have read the paperwork rather than just accept a "free" hire car.
