It is claimed that Civil Enforcement Ltd sent penalty charge demands to various addresses across Aberdeenshire.
The London company allegedly said that the notice was enforceable under schedule four of the Protection of Freedoms Act.
But yesterday, prosecutors claimed the firm did so despite knowing that the legislation does not apply in Scotland.
The case had its first calling at Aberdeen Sheriff Court where the business faces 11 further charges relating to car parking in the Grampian region.
It is claimed that one consumer was sent “persistent and unwanted” solicitations by letter requesting payment for a parking charge notice between December 2013 and April last year.
Well, CEL won't be the only PPC working on these lines in Scotland. I'd hazard a guess that most, if not all, are quoting PoFA 2012.

Sorry to pour cold water on this but at best they will be out of operation for 6 weeks. They will then be back. They know it. You now know it.
