NGPM PCN Received Capital Retail Park Cardiff

I have received a notice to registered keeper for a Parking Charge Notice dated 26th February 2015.
I am embarking on my appeal journey but just have a couple of questions.
The event occurred on 20/2/15 - their notice above was received on 27/2/15.
Some background:- At Capital Retail Park where there are many retailers so no one retailer to appeal to.
The owners of the Retail Park are Aberdeen Asset Management from Feb 2014.
1) I, being the driver and keeper cannot be denied as the photo evidence shows me sitting in the drivers seat - I was waiting in the car whilst my wife popped into one shop only (the only one shop we wanted to get something from) in the park and for no more than a couple of minutes. In fact her receipt is timed at 12.38hrs and the time the ticket was issued for was 12.36hrs.
2) I saw whilst waiting, a person out of the corner of my eye circumventing my car and looking a little suspicious (I later discovered he was wearing a jacket and on the back it identified 'CIVIL ENFORCEMENT OFFICER PARKING'). I didn't realise it was me he was looking at as I didn't think I was parked wrongly. He made no effort whatsoever to speak to me or put me right as to my potential wrong-doing - Just sneakily creeping around my car at a reasonable distance so as not to alert me - Entrapment?? - just to try and gain money!
3) The ticket say's I was parked in a Motorcycle Bay - but there were no signs saying that this was such a bay and that cars were not allowed there anyway - It didn't look like a motorcycle bay to me and in fact motorcycles park in ordinary car bays - I have since been back to the site and photo'd this 'bay' and a bike, being parked 20 yards away from this 'bike parking bay' in a car bay! (The biker didn't know either and will he have to pay a fine for parking in a car bay?)
4) The notice boards (there are quite a number) makes no mention of restricted parking in 'motorcycle bays' - only, apart from the usual don'ts, not to park in hatched areas. This clearly is not a hatched area although the parking bays were of smaller size than the usual ones for a car. Motorcycle bays usually have yellow painted image on the ground or a silhouette image of a bike on a post - No such thing appears here.
Questions -
Do I still deny knowledge of the driver? Does it matter that I can be seen in the photo evidence? Obviously NGPM do not know that the driver and keeper are the same person.
Does it matter that this was a motorcycle bay with no references for cars not to park there?
Should the attendant have spoken to me?
Thanks for any help - I will be using the template for the appeal - Do I leave out all my references to motorcycle bays, no signage, attendant not speaking to me therefore trying to 'trap' me for monetary gain?
Hopefully I won't have to pay this as I feel I have been duped/trapped but as they have my mugshot (if they enlarge the photo) do I have to swallow my pride and pay?

They don't have any facial recognition systems, so they don't know that the person in the photo (driver) is also the RK. And the only time this could be the case is IF they ever took this to court.
And "what happened" is irrelevant. Even if you WERE in the wrong, the charge being sought is is a disguised penalty, and does not in any way represent any loss suffered. (i.e. the "sentence" far exceeds the severity of the "crime").
Just use the template appeal as-is - this prevents you falling into any Me, Myself and I traps.0 -
Just use the template 'as is'. How would anyone know that you (the RK) are the driver. There's no identity parade in this game. You need to tackle this assertively, not feel bowed by a tin-pot outfit like this one.
Get your appeal off (don't fack around trying to alter things in it with mitigation stuff about motorcycle bays and the like - unless you know more than the expert who penned it), then get your POPLA code, where, by using the NEWBIES FAQ sticky, you will see this kicked into the long grass - permanently.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

plus you asked about you or anyone else paying a fine ?
there are no fines for you, nor for anyone else, they are not fines at all
you and anyone else have received an invoice for an alleged infringement of a vehicle, of which you may have been the driver, or not the driver
as you have a postal NTK, use an RK appeal to the NTK, so as mentioned above no dropping anyone in it
as also mentioned above, "what happened on the day and to whom" isnt relevant , so dont overthink it , its not a council penalty, just an invoice dressed up as one0 -

Quick Question please... Should I write to the Land Owners and/or retailer that was visited condemning the actions of NGPM asking/demanding them to get it cancelled or just leave it to the formal appeal letter? - It seems to me that a letter to either of them becomes more factual based about the event and could therefore compromise the driver's identity. Of course, unless this letter is written in the same manner as the appeal. - Just wondered and thanks0

Update re New Generation Parking Management - Cardiff Bay.
You may remember that I was waiting in a non-clearly marked motorcycle bay for about 10 mins whilst my wife popped into a toy shop to buy something. I was sent a NTK with 2 accompanying photo's for the privilege, but without the parking attendant bothering to come and speak to me at the time.
Need to thank all you guys and this 'WONDERFUL' support group forum.... NGPM have sent me a letter today saying that their Appeals Managers have peronally investigated the claim and, after careful consideration of the various points I raised, have agreed to cancel the parking charge with immediate effect.
And to think I felt worried and threatened enough that I was going to pay the 'invoice' before the rate was going to increase by 67% if I didn't pay it quickly. You guys said don't be worried, be ANGRY that they dare purport to be something they are not.
My wife who wanted me to pay it immediately for fear of increases and escalating reprisals, is certainly singing the praises of this group and 'SOUND' advice form our very learned friends!!! Cheers guys ;o)0 -
