Ee contract

Hi all,

I am wondering if you can give me some advise. There's a contract phone that was taking out in phones 4 u and obviously they have now gone bust. I have spoken to Ee and asked for a copy of my contract with my signature on which they cannot give me as they don't have it. Where do I stand do I have the right to cancel the contract?

    No, your contract is with EE not phones 4 u

    AFAIK, only credit contracts regulated by the Consumer Credit Act have to be signed. Mobile contracts aren't.
    Our life is full of contracts that are never signed. This doesn't make them void.

    The fact that you have been using the sim for a long time and paid your bills is more than sufficient proof that the contract existed and that you agreed to it.

    You can certainly cancel the contract if you wish. But if the contract is still in minimum term then you will be charged an ETC equivalent to the remaining value on the contract, so it makes little sense to do so.
    No free lunch, and no free laptop ;)

    I assume you have used the phone and service and paid the bills previously? If the answer to this is yes, then it is deemed you have accepted the contract.

    Even if you hadn't, as Grumbler says, service providers are not covered under the consumer credit act and they don't have to provide a signed copy of your contract for it to be enforeable.

    So how do they have all your personal details, your payment details and a direct debit authorised on your bank account and why do you have a mobile handset and sim from them?
