What Fred pretty much sums it up for me
I've paid and moved on now. Only slight bit of justice is that it still cost them over £700 regardless of the money I paid them.

as you say though, pay up and move on. chalk it up to experience.
I am NEVER selling a car privately EVER. but having said that I usually sell mine at the end of their life for 'spares or repair', or spank them so spectacularly there is no coming back from the accident.

OP I've been lurking on this thread and sadly after reading a ridiculous judgement on mumsnet about an ebay dispute a couple of years ago, I am not in the least bit shocked it went against you.0 -
Gobsmacked at the outcome. Was it absolutely clear in your court papers, and did you reiterate on the day, that it was a PRIVATE sale. This seems to be the absolutely fundamental point here.
Unless we've all misunderstood private sale = caveat emptor for years!

I don't know much about court stuff, being such an honest bloke and all that... but is there anywhere where you can read about this case, and perhaps any notes as to what the judge was thinking? I know this is a public forum, where we only see one side of the story and only the facts the OP wished to disclose, but if it really is a 'miscarriage of justice', I want to see it put right. Country has gone tits up as it is without our supposed best legal system in the world failing at what looked like a simple case. I'd be willing to stick a bundle of cash* in some sort of fund to help you fight this, and if there are any solicitors on here willing to right a wrong, again assuming there is a case to fight and are happy to do this MSE style, then fight it!
* I've had a few ardbeg uigeadails so far this evening, I may have forgotten this bit by tomorrow morning.0 -

When you step foot in a county court you must be prepared to appeal to a real court the decision.
If you are not prepared to appeal, as I have advised many, stay out, pay up and stay away.
A county court judge does not have to use or follow any law, they can make it up as they go along which is quite obviously what happened here.
Where you can provide case law to show the decision made on law was incorrect you have immediate and automatic right of appeal to a higher court where the the law must be applied.
You can still appeal if you have paid and you get every penny back plus the costs.
Wipe the grin from their faces by filing an appeal form.
