  • You are legally entitled to live in the property until bailiffs.
    So basically the LL has to give you a S21 notice (2 months). He has to be very careful with the dates he puts on the notice for this to be valid. Once the notice expires he will have to apply for a possession order and then bailiffs. It will take around 2 months or even more. If the LL hasn't protected your deposit the courts won't accept the S21 and he will need to either protect it or return it to you in full before serving a new S21.
    This will give you more time to find a property.

  • It isn't my tenancy. The house comes with someone's job and they have decided to retire.

    The boyfriend passed the credit checks but he rung and told them be is under debt management. He earns 20k with bonus's.

    The only person we know who could guarantor is his mum but she's retired. Although she must have savings from her mum's house sale last year.

    Nothing on Gumtree.

    Worked out between my accounts I have 22 months worth of rent sat in the bank.

    I don't get it.

  • Firstly your obvious priority is finding somewhere to rent. If possible you need to meet the landlord in person and explain that you will be on maternity leave but you can pay 6 months up front if necessary.
    Secondly the situation with your current house sounds a bit complicated. It seems you are not a normal tenant? I assume from what you've said that you are subletting from someone who is on a tied contract? I'm not sure whether you would be classed as permitted occupiers or tenants of some kind (although not tenants of the landlord). I suggest you speak to Shelter to clarify your position. This will tell you what notice you need to be served and what help you can get from the council (or not).

  • Yeah I'm subletting but the landlord knows that.

    Yeah I was annoyed with the boyfriend.

    In our area that's not enough for a deposit especially with maternity leave factored in :(

    Why does it matter that your mother is retired? I've had a retired person be my guarantor, all that matters is that their income is high enough (which is perhaps what you meant).

    Sometimes retirees are discounted as guarantors despite their income. I don't know why. When my brother was looking for a guarantor my parents offered but weren't accepted as they are retired even though they own their house outright and have decent pensions. My brother asked my but I was suitable evasive which was just as well as I later discovered he was paying off arrears on a different rental property. Bullet dodged.
  • They said that they only accept retired persons of they have a certain amount of savings. Fortunately she's confirmed she had but can't proceed today as she doesn't have access to her statements.
