  • Thank you once again for responding however there is the slight and I stress the slight possibility that they may not have received the letter!!!

    So as I mentioned before I was going to resend everything but this time do it registered delivery and await a response...

    I have also now got the details of the managing agent for the property/land of the clinic and will be ringing him to see if they can intercede on my behalf or give me details of the landowner so I can write directly to him/her.

    They lose lots of letters. Lots and lots of letters. Funny that.

    Send the complaint to the BPA Ltd as advised.

    If you simply re-send, they will say you are too late to appeal and pursue you even harder.

    In that template letter above (immaculately written by someone who clearly knows what they're on about and is probably very good looking too) don't forget to alter the date that you sent the appeal letter to match yours.

    they may refuse anything that has to be "signed for" , which is why we advocate it being sent with a free certificate of posting at the PO, that was all you needed, nothing more, and FREE too

    so adapt the complaint and send it anyway , giving copies of all correspondence and the date the appeal was sent

    as mentioned above, you dont have time to "faff about" , so dont

    definitely complain to the landowner too
  • Ok just spoke to the gentleman who is in charge of the site, he agreed that the PCN should have been cancelled and said I should ring them to explain. I feel that this might be diversion tactics so as to not get involved. But when I insisted that this would not help he has now asked me to send the PCN ref number to him by text and he will call them to see what is going on etc... Not making any promises he said.

    I will wait for his call (hopefully he will ring me back) if obviously it's not great news I will thn do as advised and contact Mr Clark as advised.

    If he comes back and states that he has instructed them to cancel, try and get it in writing.

    you do realise you can appeal on the PE website for free, online , I take it ?

    if you are within the initial 28 days for appealing , copy the template letter (or your postal appeal) , remove the rant and other details to reduce the size and post it on there anyway , asap

    your dates indicate you are just within the timeframe IMHO so get an online appeal in , TODAY

    as above, get any cancellation in writing too (get a paper trail going for all of it)

    maybe so, but my point was and still is for you to appeal to PE on their website TODAY with a copy of your appeal, or the template letter from the NEWBIES sticky thread at the top of this forum , adapted to remove the rant, plus add the mitigation and send it to PE, today , on their website (not by snail mail)

    I cannot be any clearer than that , although I feel I am banging my head against a brick wall here

    you can leave the s clark letter for a day or two, no problem
  • i thought if I was to appeal online that I would have no evidence to prove I had sentit and again they could say they never received it.

    However it's easy enough to do so and again will take your advice and re appeal.

    just do it anyway, so its with them regardless, within the 28 days

    its free, serves a purpose and could be 2 minutes of wasted effort yet it could also save you from being in court due to being naive and misinformed and new to all of this

    I dont care if you do it 10 ways as long as the ticket is cancelled at some point

    you do not want them to wriggle out of it on a technicality
