Authority to cash a warrant

My daughter wants to get money from her National savings investment account to buy a car. We live in Spain, and we can either have it transferred directly into her Spanish bank account or sent by crossed warrant to be cashed at any UK post office. Unfortunately she has an embargo on her bank account for a fine so if it goes in there it will probably be taken out before she can get it. My question is, if she had a crossed warrant sent (it will go to my mum's address in the UK as this was address used when the account was opened when she was a baby) can my sister cash the warrant if my daughter sends her a written authority and a copy of her passport? If so, is there a set wording? Any advice would be much appreciated, thanks

So why don't you, or more to the point, why doesn't she? Her money, her decision.

Bank account embargo - as in a UN one?

Crossed means it need to get paid into an account of the same name.

Does she know what the embargo is for? If it is a tax liability or debt, then eventually they'll just go after her next asset, which could be the car she is intending to buy.

The answer is NO - the sister cannot cash the warrant. There is no form of authority that exists that would allow it.
  • Heng Leng, thank you. Colsten, why don't you read the rest of the thread instead of just answering one part of a sentence? Masonic, the fine was 4 years ago for trying to take too many cigarettes through customs out of Gibraltar (only 200 allowed she had 400). The car will be in my name with her as named driver.

Well your understanding of Spanish law is probably better than mine, so I hope you have looked into the possible ramifications of what you are intending to do.

If she can cash the warrant in person at a PO, it basically comes down to whether it is cheaper to pay the fine or go on a return trip to the UK.

I did respond to one of the alternatives - the easiest one - you had mentioned.

Are you now saying this alternative does not exist?

As her parent, should you not be helping your daughter to understand the importance of settling her debts rather than assisting her to circumvent the law.
