Flight delay compensation

Hi


Wondered if anyone could help. I booked a British Airways package from Aberdeen to New York and we flew from Heathrow to and from JFK with American Airlines. We had a delay in returning to the UK and was more that 3 hours delayed in returning. BA have said I can't claim through them and has to be American Airlines. Not sure how I stand with this one... any help??

    AA are not an EU airline, you were delayed departing outside the EU = no claim under EU261
