14 day Consumer Contracts Regulations rights to return (online)?

I bought a subscription last year and naturally the company decides it best to renew automatically 12 months later to save me the hassle.
Due to several reasons that I won't go into I am not happy with that and have written them a letter asking for a refund and end of subscription. As you would expect, the email hasn't been answered and I am calling them tomorrow about the situation.

Now what is it I need to quote about consumer rights when it comes to returning something purchased online?
14 day Consumer Contracts Regulations rights - is it enough just to mention that?

The goods were sent but I didn't open the envelope and in my email said I would return it unopened.
To their defence, they did send a reminder about 10 days prior to charging me the subscription fee but I am still within the 14 calendar days.

    You took out a subscription 12 months ago, and now, 12 months later, you want it cancelled & refunded?

    Any 14 day Consumer Contracts Regulations rights would've taken effect when you took out the contract... i.e. last year.


    (we'll ignore for the moment that the CCRs weren't in place then, but previous legislation had similar effect)

    Sorry if it was unclear. I bought a subscription over a year ago and all was fine. Now 12 months later the company decides to renew the subscription, which I'm not happy about.

    I believe they have to send out a renewal reminder (via email or post) 14 days before taking the payment... if they did this and you failed to cancel in this period, I don't see that you have any legal right to a refund, unfortunately.

    This is a continuation of the original contract.

    Are you sure their decision 'to renew the subscription' wasn't made a year ago and one you agreed to at that time?

    It's not a new contract, it's a continuation, CCR's don't apply. As you say they sent the relevant info to you but you failed to act on it when you needed to.

    So the take home message is that the clock started ticking when they notified me about the impending renewal, not when it happened.
