i'm not sure thats correct? The council sends the fine payable within 21 days. Not paid within 28 it doubles. Then prosecuted in court up to £2500!
The council and school are aware i did not consent i was not on the application form and did not apply. The custody days is irrelevant as it clearly states being a 'natural' parent. You are correct the la do not have to take this to court but knowing the whole story would not back down over the fine or withdraw.
1: Only a court can fine you. A fixed penalty notice is not a fine. You plead guilty and avoid court.
2: The fine is not to exceed 1 weeks salary, upto £2500. Not everyone pays £2500!!!
3: They didnt back down, because they didnt have to. You werent taking it to court where the defence would be tested
4: You also got zero legal advice0 -

Just an FYI taking advice from the council is not a good idea in this instance.
This is an income to them. They rely on scaring people into paying up.
I'm sure they said that the fine is upto £2500, but did the mention the court will look at your circumstances financially and would actually be equivalent 1 week wages? - I know they didn't by the way...

They can't impose a fine, only a court can...
Only a court ( or you pleading guilty ) can decide if your guilty...0 -

Omg it's worse than explaining this to my son, who's 5, and probably has ADHD.
For goodness sake give me your address and I'll send you a bloody invoice, and I'll include a timescale if it helps!
You have an invoice ? No you don't. An invoice is something you get for goods or services rendered.
You have a fixed penalty notice. Which is not a fine.
A fine is what a court orders you to pay. If you don't pay it, bailiffs come and take your stuff.
Without being funny I can see why the council didn't feel they needed to cancel their FPN given your legal prowess0 -
OP- I read this thread from work but was unable to reply till now. Please get in touch with the campaign group 'Parents Want a Say'. They campaign to overturn the current rules re term-time hols back to how they were prior to Sept 13. They'd be interested in a case like yours and can offer support and advice, they have an MP who is involved, though I can't think who it is at the min. PWAS have a facebook page if you are on there. Thanks spendless I have been in contact with Parents want a say,
they have been fantastic, very helpful and supportive. There are few places to turn. They have been instrumental in the fine being withdrawn. The MP didn't get involved as I had already contacted Chloe Smith.
