    Yes, I figured they would fail, do I do them asap or wait until its been 21 days?

    dates of incident 27th & 28th January and both notices were sent/issued on 12th February and received on 16th

    What postmark date was on the envelope, if you still have it? What postage class was used? (1st?)

    16 days after the event means there is no keeper liability ... POFA requires the NtK to arrive within 14 days (or after 28 days. if there was a windscreen ticket). Anything inbetween means no POFA compliance means no keeper liability.

    But looking at the dates you state ... 12th Feb is 15 days after the 28th Jan; which means they didn't even create the NtK until too late anyway, never mind have it arrive within the required timeframe. :)

    If the NTK's are dated 12th February, then date of receipt is deemed to be 2 working days later; (i.e Mon 16th Feb). So too late for POFA.

    As I said, even the 12th Feb was too late. :)

    As the NTK's were received after 14 days, then only the Driver is potentially liable.

    Do i still need to appeal? tell them to basically stick it where the sun doesn't shine as they can't prove who was driving? ignore?

    You still need to appeal; otherwise they could keep chasing you for up to 6 years.

    Unless any of the forum 'wise owls' say otherwise just add a a line or two in your first appeal(s) saying that the NTK fell outside the required period and that therefore POFA non complaint.

    do not let all this worry you it's just another arrow in your quiver for the POPLA appeal ;)

  • Just want to thank everyone who gave advice about this, i emailed my appeals off this weekend and have had an email back today saying they've been successful and the charges cancelled
