rights when buying from a 'business' site

Hi,

About to purchase online from a 'business' site, although the prices do not mention VAT - so assume they are including VAT as the total does not increase when checking out to paypal. I say business as the items are all business related.

Under the very brief FAQ page it says 'all sales are final'.

Is this legal?

Can one return if not happy? Or are we really limited by law?

The items are items such as a spreadsheet or word document, although some are books etc.

    You have more protection when buying as a consumer.

    Your buying the books as the course of business as it's all business related so you are operating under a B2B contract so consumer law doesn't apply. Although the T&C's are very short they do get straight to the point and are legal.


    The downside for him however is he doesn't really warn you that you are entering a B2B contract so if you wanted a refund under the CCR and had to challenge him in court you would probably win. A judge may decide that the information has no other reason other than business so decide it is B2B but that's the gamble you would have to take.


    The question is why are you interested in his products, it's to make money I assume so you are buying as a business, no?

    You are protected as a consumer as long as you are a consumer and not a business. It does not matter where you buy from.

    That website is no more a 'business' website that Amazon et al.

    I could not find their T&Cs though they make you confirm that you read them when you order...
    When in doubt, pass.

    Was just curious as to how the law applied if buying online.

    A bit crap that essentially someone could set up a site and sell rubbish with no content or very poor content and be exempt from the law, short of a legal case.

    Okay, so it is a risk - fair enough :)

    someones been on ebay and purchased an ebook script and added physical books.

    I have exactly the same script, but done nothing with it as yet

    Which to me is at odds with what he says on the 'about us' page.

    As said above, I'd avoid.

    VAT is added to the prices shown when going through the checkout process.

    they say they are located in Northamptonshire, but the details relating to who the domain is registered too is hidden, so they could really be from anywhere in the world.

    site is a cheap ebay purchased script that does not look professional

    i would stay clear
