Buyer has lied about not receiving item

And paypal/eBay have decided in his favour and refunded him the money.
I sent the item out 3 days late due to my lo having chicken pox and not being able to leave the house. He emailed me and asked me where it was and I explained and told him I would be sending it out the next day. The day after this (before it had a chance to get there!) he started a claim.
I emailed him and explained it can't have had time to get there and if it did go missing he would have to wait 3 weeks to get a refund through RM. He said he would wait 3 weeks for the refund -effectively telling me he would report the item missing before it even had a chance to get there.
Anyway he escalated the claim after 1 week and got his money back.
Can I show eBay this message and get my money back? He basically told me he would be reporting it missing before it technically could have been.
Fuming - hate cowardly thieves like these

It would have been a good idea to inform your buyer you were unable to send the item before they contacted you.0

I'd get hold of eBay and argue until they give in - however, when you sell something you enter into a contract. You said you'd send it within a certain time and went over that.
Did you get a tracking number? I'd pass that on to eBay to show that it's been posted.0 -
you have probably put the buyers back up by saying they have to wait for 3 weeks before they can get a refund if they dont receive their item.
You have to wait 8 days i think from opening a case and then escalting it to get a refund ,so its not like your buyer hasnt already waited.
You have no proof buyer has the item or that you have been conned.
Sellers that tell a story as to why items are being posted late [even if true] are treated very warily and most buyers will open a case just to make sure they either get their money back or their item. The reason being sellers have been known to not post for a variety of reasons and string the excuses out till its past ebays claim time.
As said above if your knew item was being posted out late it would have been a good idea to keep your buyer informed and less likely to view you with suspicion and rush to open a case.
Just to add making any buyer wait longer than 2 weeks isnt on.

You can't treat buyers like this. Buyer asked where his item was and you informed that it hadn't even been sent yet and if it did go missing he'd have to wait 3 weeks to get any money back, which would be a month after purchase. Any buyer would have been fuming at that nonsense. That's asking for trouble..0

There is a time restriction to open not received case - before that they can't open a case hence waited long enough.
Have you send it tracked or do you have proof of postage in other form?ally.0 -
I think you've got the gist of the advice.
Put yourself in your buyer's shoes and see how you would feel being treated this way.
If you are delaying sending an item, you must let the buyer know. You must also give them a chance to cancel if they don't want to wait.
If an item get's lost the buyer doesn't have to wait 3 weeks, it's irrelevant how long it takes you to claim. You might not receive a refund from RM, or even if you do it could be weeks later. That is not the buyer's fault.
Next time you get an INR and if you haven't sent it tracked, make enquiries with the buyer to confirm their address, ask them to check with their neighbours and try and do an online redelivery (if it's with RM).0 -

Unfortunately ebay has tight terms and conditions and if item cannot be shown to be delivered then buyer will always win. Have a look at the sticky postage thread.
Also showing proof of posting is also not going to win a case.
OP- ebay do expect a highly professional seller now, even for private sellers and as has been said if you can't post within your stated time frame it always pays to let the buyer know. I suspect though that as the others have said, you immediately riled the buyer by telling him he had to wait for you to do a claim via RM, when of course that claim is nothing at all to do with him.

Unfortunately this has hit the nail on the head. I do not think it is just Ebay that expect all sellers to be professional, regardless of whether they are a business or not. Many buyers do not appreciate or even realise the difference between a business and private seller.
I do feel for the OP as if you are just a casual private seller on Ebay then you are often oblivious to what can go wrong and what is expected of you.0
