Section 75 claims

My Son bought a car in September last year. Within 5 days we were aware of a problem with the car. The garage have been awful.
We paid £500 deposit on a Tesco Visa Card & the balance in cash. We put in a chargeback claim for the deposit & a claim under Section 75 of the Consumer Credit Act 1974 as advised to do so. Our claim has been turned down as I can't find a connection between the Debtor & Creditor. ie the name on the deposit receipt & the garage.
Any advice would be appreciated.

    So you paid the deposit (on the credit card) to someone other than the garage?

    We paid £500 to the garage by Visa card. The receipt shows Car Seller UK. This was paid in the showroom of the garage. We didn't even notice a different name. This was attached to the receipt given by the garage Hurn Forest Motors. Tesco Bank have said we have to prove the connection ie same Directors. We have checked Companies House & nothing listed.

    Don't give up on section 75 just yet - this couple had to prove there was a link and the FOS helped them to get to the bottom of it:

    You're free to choose whether to pursue the garage or the credit provider. If you go for the s75 claim and it doesn't work out, you could then be out of time to go to the garage directly and reasonably reject the car.

    This doesn't make any difference. The point was that you used your CC to pay for your son's car.

    Even if your son were a secondary cardholder he wouldn't be covered:
  • For S75 to apply the account holder of the credit must directly benefit from what was bought. If you bought him a car as a gift or loan then the chain is broken as you do not have direct benefit and so no S75 protection.

    If it was his credit card (ie he is the account holder not a secondary card holder) then it'd potentially be different.
