I bought car and paid deposit with credit card, and got receipt of car trader,several problems with car,tried to claim off credit card on section 75,unknown to me deposit payment went to other company not car trader,card company tell me I am not able to claim.???? any advice welcome.

You have S75 protection with the company you pay, hence if you pay a merchant via PayPal you effectively have S75 that PayPal will actually pay the merchant and no S75 protection about services/goods from the merchant themselves as its not them you paid with the card.

You need to validate exactly who you paid -v- who was in contract with you to provide the car

Why won't the dealer assist you in your problems with the car?

If all else fails, flog it and get another (from somewhere else), but this time ensure you get it properly inspected before buying.

You don't have more rights against the CC company than you have against the car trader. If you feel that you are right, just sue the garage. Generally, SoGA covers second hand goods the same way as it covers new, but with a second hand car it can be not that strightforward.

I only found out about the payment to other party after getting statement from card company,did not know that payment was not to car trader,have tried contacted him by recorded delivery letter which was returned no postbox,and by telephone no response.card company refused refund said not liable because payment made to this other company.

Where did you buy the car from?
Was it a sole trader or a limited company?
Business name & address please.

How long ago did you buy the car?
When did the first fault occur? When did you report that to the seller?
When was the most recent fault? When was the last time you were in contact with the seller?

What does your payment receipt say?

Receipt says deposit for car with registration no.ect. on compliment slip of car trader.

I was thinking more about the actual card payment itself, i.e. the receipt from the Chip & PIN terminal or even a manual imprint voucher, etc?

There was no receipt from the card terminal given only his receipt.
