I have only just realised they don't actually say at any point in the email that my appeal has been denied. Is this significant?

Not greatly - its just indicative of the sort of smoke and mirrors that are common in the PPC biz. Nothing is at all what it seems.

Redx laid-it all out for you - Complain firmly about this. :)

Nothing wrong with that, they are just commenting on it as a distraction technique. Ask them if they filled in a standard form or a bespoke one when instructing the debt collector!

All PPC's send out template letters too, it's just part of the game!
When I received a recent NTK I replied that I was in receipt of one of their ridiculous template invoices, just to get in first!
  • So I've finally gotten a POPLA code after an exchange of emails with the BPA.

Looking of the BPA code of practice, I've noticed that the NTK I received is lacking multiple pieces of information that are required.
    These being:

d the time and date when the vehicle was first seen (if this
is relevant for the alleged unauthorised parking event)

e the time and date the parking charge notice was
issued - It only shows the date.

h the ‘identifier’ of the person who has issued the parking charge notice – for example, an ID number

i the operator’s registered company name and number and, if the operator is using a trading name other than its registered company name, a geographical address where documents can be served - Unsure of this one as ALL mail correspondence has come from ZZPS rather than Vinci. Vinci is simply listed as their "client".

    Is it POPLA time? ;)

As mentioned before, I have not once heard from Vinci directly. The NTK from ZZPS had their logo at the top, but their company information is nowhere to be seen.

    Yep, It's POPLA time

See post #3 of the NEWBIES sticky thread and check your POPLA code's validity using the link to the Parking Cowboys POPLA checker which will give you your deadline date.

1st three digits of POPLA code identify the company - I think Vinci ones begin 91 but I'm not sure about the third digit.

All the failures in the Ntk fall under a
"NtK Fails to comply with the statutory requirements of POFA 2012 Schedule 4, therefore the parking company have failed to establish the right to pursue the keeper" challenge.

The Parking Cowboys website says I have until the 17th of May to appeal, however the POPLA website says my code is invalid.
  • Any ideas guys?
  • Because the newbies thread post #4 states "IF YOU HAVE AN EXISTING THREAD AND GET TO POPLA OR IAS STAGE YOU WILL NEED TO REPLY ON YOUR THREAD TO GET THE LATEST ADVICE", I am back.

After conversing with the BPA, it was determined that the POPLA code is indeed valid but the POPLA website is having issues, so I need to appeal via email. These issues with the website have caused me to go over the 28 day deadline, but I have written proof from the BPA stating that this is not my fault so I'm guessing it shouldn't be an issue.

Where can I get help writing my POPLA appeal? There is SO much information here but I'm a bit stuck on where to start when it comes to writing my own.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
