As Thomson's "default position" seems to be blaming every technical problem as a "hidden manufacturing defect" do you think it would be a good idea to update the guide.
My own view for what it's worth is this defence isn't worth powder and shot because:
1. If there is a manufacturing defect, hidden or not, the airline will have raised a complaint with the manufacturer, and as such there will be substantial correspondence. It is all disclosable.
2. It is likely to apply to more than one aircraft of the same design so there will be correspondence between the manufacturer and all airlines flying this type of aircraft. Product recall perhaps?
3. I am not convinced that even if there is a genuine case of a hidden manufacturing defect, this is sufficient to override Huzar.
4. The airline will be entitled to compensation from the manufacturer including an indemnity against passenger claims.
In short, I suspect that the whole thing is a scam on Thomson's part.

But I do happen to know of someone who recently got paid out by Thomson, without having to go the court route, so it's not necessarily a default position adopted by them.0 -
hi guys in september our flight coming home was 4 hours late due to there being a technical fault with the plane and then having to wait for a mechanic to come to the airport from the other side of the island, therefore we arived back to the airport 4 hours late, I used the teplate letter from this website and filled it in and sent it to thompson, they replyed just saying sorry and to just get intouch with my insurance company, is there correct do i need to now get intoch with them or is there someone else i can go to? thanks0
