    Hi I tried to reclaim for the misselling of my packaged bank account with Halifax. I was told I had to apply for that account if I wanted an overdraft (after two or three head office reviews of my cash card account to upgrade to a current account with overdraft which they kept rejecting. Eventually someone at head office told me to apply for the ultimate reward account which I did online. I think I did claim once on the breakdown but that is all that I can recall. Anyway I tried to open a claim through resolver and Halifax phoned me a day or two later saying they couldn't uphold my complaint as it was opened online and also I'd made a claim under the account for breakdown. They said I'd get their final response and could take this to the FOS if I was unhappy but I'm still waiting for that letter some 3 months later. I feel strongly that I was missold the account even though I applied online I only did what their head office suggested. Do you think I can get anywhere with this anyone? Or is it pointless if I claimed on the breakdown ? They also increased their fees without informing me while I held the ultimate reward account from £12.50 to £15 I recall, and then later apologised for that some months down the line. They eventually reduced my account to a reward account only when they saw I was getting into difficulties with the overdraft. Any advice gratefully received. Thanks

    How can you be mis-sold if no one (mis)sold it to you?
    If you applied online and have an unsuitable product, it means you mis-bought which is not a valid complaint reason.

    Allegations of wrong-doing against a nameless employee at Head Office will get you nowhere, I'm afraid, as will claims that you didn't receive letters.

    I'd let this one go if I were you...

    A logical complaint rejection. It wasnt sold to you. You chose to buy it direct.
    I feel strongly that I was missold the account even though I applied online I only did what their head office suggested.

    All you need to do to win your complaint is provide them the evidence that backs up your allegation.

    It reduces the chance of success that was already as about as slim as it could get to begin with.

    On paper, it just looks like you applied online, used the benefit and are not complaining about a mis-sale when no-one sold it to you.

    The advice is quite harsh on these forums makes me think twice about asking for help again! I know what happened and yes its my word against theirs but their head office will have record no doubt of my account reviews for overdraft so I'm gonna try again through FOS anyway

    Both responses were fair and accurate assessments of your complaint. You really don't have a valid case, as the Ombudsman will doubtless agree.

    No harshness there. We cannot magic up a solution for you that you want to hear. No point telling you lies to make you feel better.

    It doesnt mean the FOS will not overrule the outcome. Funnier things have happened. However, as you have described what happened, the evidence will point to it not being mis-sold. Buying online gets less consumer protection.

    Had a refusal letter from Nat West today after I complained at 6 years worth of fees from 2000 to 2006. I had a very valid reason for cancelling and was told by the lady in my local branch in 2006 that it wasn't worth me having it! I wrote to them in 2006 and they ignored me then.

    They said the Ombudsman won't look at my complaint as it is out of the time limit.

    Is it worth trying the Ombudsman?

    They have already told you that they are activating the time bar to prevent the ombudsman from looking at the complaint. So, no. it is not worth going to the ombudsman.

    Only if the timebar was being incorrectly applied could you do that. However, in your case, it is not as you are way past the time limits.

  • I got paid out a fair number of years ago for a mis sold package bank account and I'm SURE that tax was taken from my payout, but I can't remember the amount - I was just happy to get the payout.  It seems now that I should NOT have had tax deducted from my payment? Any idea if I can get this tax paid from my payment back
