Insurance question

Im hoping someone wise will help me.

Whilst my car was parked outside my house, a drunk driver with no license crashed into it. My car was then pushed into my neighbours, and both are write offs. Luckily the van tht cause it is owned by a business and i can claim through their insurance, but the police told me id be liable for the car mine crashed into.

Surely this cant be right? My car was empty at the time, as it was early morning and i was in bed!

    The police are not the experts on civil law/insurance liability etc! (The drunk driver is liable for all the damage he caused)

    True, as I understand it though the owner/keeper of the car in front of the OP's raises a claim against the Op's insurers.

    They can if they want to, but it would be a lot more sensible for them to claim directly off the liable party.

    The OP is liable at present, that is not to say their insurers cannot claim from the offending party.
    When you get muliple pile ups on the motorway this is what happens.

    This is often phrased as the insurers bearing their own losses.

    Car 2 can either claim from the TP or car 1. If they claim from car 1 car one should be able to claim for that pay out from TP. It would be much easier for all involved for car 1 and 2 to claim from TP.

    I guess though that as the offending party was intoxicated, there may not even be a policy to claim against :eek:

    Indeed, in which case car 2 owner, you are scuppered :mad:

    Though the OP does say they can claim off the company insurance.

    For the OP to be liable, they would need to have been negligent.
    I can see how the drunk driver was negligent, but not sure how the OP could have been deemed negligent if they were not in the car and assuming it wasn't parked illegally.
