    i sent a letter requesting my back charges on the 28june, 6th july the bank
    natwest sad they were looking into it and would get back to me within 6-7 weeks, to-day i recived a letter saying the bank is involved oft. so my case is on hold.
    what happens now.????????????????????????????????????????????????????????

  • my charges date from 2002-2007 approx £500
    all of my charges have came out of the disability allowance and carers allowance i recive for my child.
    i know there's a time limit on claiming back so many years, so i would need to write to the bank,something along the lines of unlawful charges comming from my social security benefits,to be honest im lost with all this and dont know where to start, can anyone help with a letter for me to write to the bank, or do i go ahead with court, help, i feel like giving in, ive enough stress caring alone for a child with a disability, any help would be very much appreciated.

    I hope this may help you i am in the same sittuation as you the abbey paid me £250.00 as a good will gesture but kept £50 for a pending charge i also have a big overdraft. I have phoned them and they have said i am at stage 2 and that it is now froze til the hearing. So i rang the fos and they are now writing to the abbey as i am on benefits and they are still taking charges. I hope this is some help as dealing with the abbey is like bashing your head against a brick wall:confused:

    Yes there is....!!

    I used to have a savings account with the co-op that I ran as a current account. ie. had all wages, child benefit etc. paid into; direct debits set up for bills; and a cashcard to withdraw money from a cashpoint.

    Because it was a savings account, I could not go overdrawn, and could not get an overdraught.

    I never got charged once on that account for anything - even on the odd occasion that there were no cleared funds for a direct debits!! :beer:
  • Hi I poste here a couple of weeks back due to A&L taking £50 charges out of my child tax credits (I have 4 kids). I sent them a letter stating under social security act 1992 section 187 this was unlawful only for them to send a response over some test case - our charges are lawful blah blah.
    I need urgent help any ideas on where to go next

  • I am on incapacity benefit and have been for 10 years. The bank has been taking charges out of my benefit over the last 6 years when they know full well that my only income was my benefits.

    I have started the reclaim process and have sent in the second letter, but the FSA case came into being before i received the standard "no you aint having it" reply.

    Could Martin or someone in the know, please link me to the instructions on how to get the bank to pay up using the benefits law?. The info on the emergency guide is kinda sketchy and i would love to be able to wield this new sword of justice in my own case but need further information on just how to use this tool..

    All help and tips appreciated.

    Has anyone either had experience or got basic :A knowledge of the Social Admistration Act, which outlines the conditions of benefit payments and bank charges being deducted from such payments, any views would be appreciated!

    Most banks will allow you to withdraw benefits, even if said benefits will take you overdrawn.

    That won't absolve you from charges though.

    Speak to the bank and advise you cannot pay them at all, they may ask you speak to for example CCCS or PayPlan to come to an arrangement.

    Otherwise you'll have to pay the full debt.
